Directed to make pro-active disclosure in 15 days, 2 months elapsed | SSRB fails to comply with orders of SIC | | Early Times Report Srinagar, Nov 4: Continuing to take Right to Information Act (RTI) for granted the Government departments keep violating the J&K RTI Act 2009 and even the orders of the State Information Commission (SIC) are being violated continuously. The SIC had issued orders to PIO - Services Selection Recruitment Board (SSRB) to make pro active disclosure under section 4 (1) (b) of J&K RTI Act 2009 , in August within a time of 15 days, but till date the disclosure has not been made by the said board. While castigating the State Services Recruitment Board (SSRB), the State Information Commission (SIC) has issued a notice against them asking for compliance report for implementation of section 4 of J&K RTI Act within 15 days. Under section 4 the public authorities have to voluntary (suo-moto) disclose information and that is to be kept in public domain on the official website by the public authorities. The order was issued on the directions of Chief Information Commission (SIC) G R Sufi after hearing from an unemployed young man from Poonch who was denied information by SSRB as he was dropped from the recent teachers selection list. One Tousif Ahmad Bhat filed an RTI application dated: 04-02-2014 before PIO, SSRB seeking information about the marks obtained in the written examination and cut off marks of the RBA category District Poonch for the selection of Government teachers . The applicant also sought a copy of his answer book. The PIO, JKSSB had informed the Commission that the appellant had applied for the post of Teacher as well as VLW District Cadre Poonch for which a common written examination along with other posts was held on 17-09-2013. The PIO passed an order dated: 11-02-2014 informing the appellant that the selection process was incomplete, hence information cannot be provided, rather it would be provided, as and when final selection process is completed for all posts. The SIC order of August 2014 had said: "After going through the records, the Commission has painfully found the continued non compliance of the public authority of J&K SSB with section 4 of the J&K RTI Act, 2009. The Commission had long back directed the public authority of JKSSB to ensure compliance with provisions of section 4 of the J&K RTI Act, 2009 which had enjoined upon him to make a suo moto disclosure of the information narrated in said section within 120 days of the promulgation of J&K RTI Act, 2009. The public authority seems not to have fulfilled this obligation cast on it under the provisions of the Act and painfully non compliance has remained unexplained from June 2009 to this date. In view of this continued and unexplained non compliance with the statutory provisions, the Commission will be constrained to initiate action under section 15 of the State RTI Act against the public authority because prima facie, it is clear that public authority is deemed to have refused to disclose the information which it was required under law to do. The J&K, Service Selection Board is the only premier institution of recruitment for non gazette posts in the state of Jammu and Kashmir. For such authority, transparency and accountability are of utmost importance. If the authorities are not ready to ensure transparency and accountability in their functions and working, it is sure that common masses who are aspirants to the government jobs in the transparent and honest manner will be hugely disappointed. Therefore, the Commission would once again impress upon the public authority to comply with the provisions of section 4 of the State RTI Act, 2009 and submit a compliance report to the Commission within 15 days from the receipt of this order". |
