Appeal filed by NGO dismissed, SIC calls it mockery of RTI

Jammu, Apr 1: State Information Commission (SIC) while taking a dig on a Poonch based NGO namely Awake India has not only dismissed its second appeal filed under J&K RTI Act 2009 , but has told NGO in writing that it was making mockery of RTI law by not being present before the Commission during several hearings. Information Commissioner Mohammad Ashraf Mir further said that applicants have only wasted time of SIC and public authority.
Details available with Early Times reveal that an RTI application was filed by Awake India through its General Secretary Parvez Mughal a resident of Poonch with the PIO/Executive Engineer, PWD(R&B) Division Poonch seeking to know Quantum of funds released on Chandak Mandi Road, Mandi Loran Road and Loran Sultan Pathri Road during the period April 2015 till date, Copies of estimate along-with drawing , Copies of all notices inviting tenders, Copies of all the comparative statements, Copies of allotments of each work etc.
As Executive Engineer / PIO failed to provide information, the 2nd appeal was listed for hearing before the State Information Commission but the applicants and respondents absented themselves.
SIC in its final order said, "Such kind of non-seriousness on the part of the appellant not only makes a mockery of the entire RTI mechanism but also results in wastage of time and energy of the State Information Commission as well as the public authority. Unfortunately, there is no provision in the J&KRTI Act, 2009 for penalizing the non-serious appellants and for taking the entire RTI structure for a ride. the Act judiciary and thoughtfully in future as is expected of a quasi judicial authority".
