| Court awards one and half year imprisonment to man accused of molesting a girl | | | Early Times Report
KATHUA, Apr 2: Judicial Magistrate, Ist class Billawar R.K.Tadyal has awarded one and half year imprisonment and fine of Rs. 2,000 on one Mohinder Singh S/o Sadha Ram R/o Parents Morh Tehsil Bilawar undergoing trial in a case of assault or criminal force to women with intent to outrage her modesty U/S 354 /341/323 Ranbir penal code.
Brief facts of the case are that on 14/07/2011 complainant /victim namely Mainsha Devi filed an application in police station Bilawar along with Babu Ram. She said that she is a student of Hr Sec School Mahanpur and she was going to tution at Mahanpur and on her return at Salehri Morh, near a jungle an unknown person came on motor cycle without registration number and obstructed her way.
The complainant said that the accused caught hold from her arm and tried to outrage her modesty by dragging her into jungle. When she raised hue and cry few people who are along with their cattle came there and saved her. Than the accused ran away from occurrence place and left his motor cycle there. Due to scuffle she got injury on her body, there after she went to home and narrated the whole story to her mother and uncle.
On this FIR was lodged u/s 354, 323 and 341 and investigation commenced. After completion of investigation challan was presented in the court of Ld. JMIC Billawar after hearing P.O. CH ASIF IQBAL appearing for the state and Ld. Counsel for the accused observed that the prosecution has proved his case beyond reasonable doubt and evidence of eye witnesses is also corroborated other evidence. The accused is proved to be guilty and liable to be convicted. The court awarded simple imprisonment of one year and six month and fine of Rs. 2,000 for commission of offence. |
