Article 35A on its last legs
Separatists making desperate attempts to appease their new bosses in Pak; mainstream politicians join the process to prove Delhi wrong
7/30/2018 11:55:59 PM
Early Times Report
Jammu, July 30: Separatists are trying to build pressure over the Government of India to use its influence to put Article 35-A, which provides special rights to people of J&K, into cold storage . They have already called for a 2-day shutdown in the Valley to begin with and have threatened to stir unrest if the Article is scrapped by the Supreme Court.
The Apex Court is all set to hear the petitions challenging the Article 35-A on August 6 and there is every possibility about it being listed for the final hearing in coming days. Or it could be the final hearing.
A legal expert while talking to Early Times said, "People who are raising hue and cry about safeguarding this Article know it very well that this is a temporary provision and it can be revoked with a stroke of pen. They know it's not valid."
The expert said that the people who have filed petitions to challenge these articles are aware about the fact that they have a strong case and Jammu and Kashmir government cannot defend it. "The common perception among the nationalist people is that this Article should be abrogated to pave the way for complete merger of J&K into the union of India," he added.
A politician said, "The Government of India should allow the Supreme Court to go ahead with the decision. People who are raising hue and cry should be ignored as they cannot be allowed to dictate terms."
He said that Pak stooges, including Hurriyat hawk Syed Ali Shah Geelani, Hurriyat dove Mirwaiz Umar Farooq and so-called JKLF chief Yasin Malik are trying to recreate 2016 like situation to become relevant. They have already roped in various organizations which could make their strike calls a success and it looks like that they want to impose yet another spell of shutdowns and protests in Kashmir. They know it's an opportunity for them to appease their new bosses in Pakistan.
It may be recalled that Central government did not file a counter affidavit to challenge the petitions filed against the Article 35-A in the Supreme Court.
"By not filing the counter affidavit the Government of India has made its stand clear that it doesn't oppose the revocation of the Article 35-A. In fact BJP has always advocated the revocation of the Article 370 since its inception. Today the party is in power and its golden opportunity for the party to get this Article revoked," said an expert.
He said that Pak stooges, who have become active in the Valley, reportedly enjoy the support of mainstream politicians also. "It looks like that all Kashmir centric politicians have joined hands to foment trouble in the Valley. They are trying to build pressure to create confusion and prove it to the GoI that they only can handle Jammu and Kashmir. All the Kashmir centric politicians, including the so-called mainstream leaders, have crossed the line and are threatening the Supreme Court. This is not acceptable and action should be taken against them for trying to influence the Apex Court," the expert added.
