| IO changed after Court's displeasure | | Infamous Zanana park burn case | | Early Times Report
JAMMU, Apr 21 : In the much publicized Zanana Park Girl Burn case where Lal Zohra wife of Mohd Aslam - the mother of the victim girl (now dead) has alleged unfair investigation by the Jammu Police, a new development has taken place. On 17.4.2014 when the case was listed before the CJM Jammu Mr S C Katal, the CPO Sanjay Kohli produced an Order of SSP Jammu whereby the investigation has been transferred to SHO Police Station Pacca Danga Jammu and sought that the petition be consigned to records. Aseem Kumar Sawhney appearing for the petitioner Lal Zohra submitted that despite a lapse of considerable time now the SHO too has not recorded even a single witness and no progress in the investigation is visible and opposed the request of the CPO. He alleged that the change of the IO by SSP Jammu is a mere eyewash as the Police machinery is hell bent to save the accused since accused is the brother of a Police officer. As per the Status report filed in the Court the Police has recorded only 4 witnesses in four months and after the death of the girl the Police has not added the offence of 302 RPC in the case and has failed to arrest the accused, the counsel for the complainant A K Sawhney submitted. On the last date of hearing i.e. 4.4.2014 the Court had observed that the IO was not present in the Court and that the counsel of the applicant had submitted that the I/O is not recording the statements of the witnesses and causing harassment to the complainant's witnesses. The Court had directed the SSP Jammu to inquire into the conduct of the IO and shall pass appropriate orders. The IO concerned was directed to remain present alongwith the CD file on 17.4.2014.
In the complaint it was alleged that complainant is a hapless mother whose young daughter has been murdered by the accused in connivance and conspiracy with certain other accused, and the Police is hand in glove with the accused since the accused's brother is an Inspector in the Police department and posted as SHO Police Station Gandhi Nagar Jammu and besides tainted and unfair investigation in general, the Police has not registered the case under Section 302 RPC despite the fact that the statement of the deceased daughter of the complainant prior to her death before the Judicial Magistrate has explicitly narrated the facts as how the hapless daughter of the complainant was murdered by immolation. After few days of getting her statement recorded which is now a dying declaration , she breathed her last due to these burn injuries on 21.10.2013 and her postmortem was got conducted by the SI Rattan Singh Incharge P/P Parade Jammu who was the IO of this case at LM Ludhiana Civil Hospital on 22.10.2013.
In the complaint filed by mother of the deceased, it was alleged that despite the fact that the Police is now let free by the High Court to use the statement of the victim (now deceased) under law as the petition of the accused has been dismissed and a bare perusal of the statement recorded by the Judicial Magistrate Ludhiana (now dying declaration) reveals that the accused has murdered the deceased, still the Police concerned has not bothered to book the accused under section 302 RPC for murder or has arrested the accused. The accused is leisurely enjoying his life under the patronage of his brother being an officer of the Jammu Police, under the support, connivance and abetment of the other conspirators who are officers of the Police department, therefore she filed the murder complaint herself to seek justice for her daughter. |
