DB gives four weeks respite to respondents over PIL on Beggary Act

Jammu, Apr 21 : In a Public Interest Litigation (PIL) filed by Advocate Parimoksh Seth seeking directions to the respondents to implement the provisions of the Prevention of Beggary Act, 1960 and Prevention of Beggary Rules in the State of J&K, Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar today granted four weeks time with the observation that the needful shall be done within this period in this regard. During the hearing of the PIL, the Division bench also observed that as per the order dated march 6, 2014, Status report has been filed by Social Welfare Department.
After hearing Sr. AAG with Govt Advocate appearing for the state sought some time to file status report in terms of directions issued by this Court and granted four weeks time with the observation that the needful shall be done within this period. Earlier Division Bench directed DGP J&K to hold survey in the whole State to find out the beggars' population specifying them in three categories viz. sick/suffering from contagious/infectious disease, the beggars below the age of 14 and are not suffering from any such disease and the children who have been pushed to the beggary. Division Bench also directed DGP may also ask the SHO of every Police Station about registration of FIRs of the missing children and the whole data shall be placed before this Court before the next date of hearing and DGP shall make all efforts to ensure that the provisions of the Beggary Act are effectively enforced.
Court also directed to make an interim arrangement of building to cater the requirement of the statute be hired so as to stop the menace of begging and the associated crimes like kidnapping so as to push the kidnapped children into beggaries. Division Bench also directed it is the primary duty of the social welfare department to set up sick homes as mentioned under sub clause (b) of Section 2 of the Beggary Act, where the beggars suffering from leprosy or any other infectious or contagious disease are to be kept, likewise Clause (g) of Section 2 of the Act contemplates setting up of beggar homes and setting up of children homes which is required to be notified as suitable place for reception of beggars below the age of 14 years."This is the primary duty of the social welfare department which has not been owned in the affidavit filed by it, court observed and issued direction to respondent No.4 to explore the possibility of complying with the obligation imposed by the Act of 1960 on it by setting up sick homes, beggars homes and children homes.
