Contempt petition by porters | SC issues notice to Secy Defence, Army Chief | | Early Times Report
JAMMU, Apr 21: A division Bench comprising Justice B S Chauhan and Justice J Chelameswar today reissued notice to the Union Defence Secretary, Chief of the Army Staff, Comptroller General Defence Accounts on a contempt petition filed by 70 Army porters titled as Isher Singh & Ors Vs Union of India & Ors for having deliberately failed to regularize their services following the order of the Supreme Court dated 14.05.2013. The Supreme Court, therefore, in the facts and circumstances of the instant case where members of the respondent Union have been employed in terms of the Regulations and have been consistently engaged in service for the past thirty to forty years, of course with short breaks, we feel, the Union of India would consider enacting an appropriate regulation/scheme for absorption and regularization of the services of the casual workers engaged by the BRO for execution of its ongoing projects.Prof Bhim Singh who appeared for the Army porters argued that the Ministry of Defence had deliberately failed to implement the order of the Supreme Court in which Supreme Court had directed the Union of India and Ministry of Defence to regularize the services of nearly 70 Army porters working in Nowshera Sector for the past 15 to 20 years as daily wagers. Prof Bhim Singh submitted that the Union of India and Ministry of Defence have not cared to file an appropriate counter in spite of the notice issued to the alleged contemnors.The court after hearing both the sides directed the respondents to file an appropriate and proper counter in this regard.
