Jammu, Oct 27 : Second Additional Sessions Judge, Jammu, M K Sharma today acquitted Tarun Gupta and Karnail Singh who were facing trial in an NDPS case due to insufficient investigation. The judge, after hearing the two sides, observed that majority of the cases under NDPS Act are failing in the courts primarily because of improper investigation and the failure of the senior police officers to monitor the investigation as required under police rules. As a result of this, the officers responsible for inefficient investigation, go scot free without any accountability for failure to discharge their due functions and duties. Efficient and scientific investigation, followed by vigorous prosecution of those accused found involved in the disturbance of rule of law, is the hallmark of Criminal Justice Dispensation System. State through SSP Jammu is directed to take steps to ensure meaningful and proper investigation of their cases so as to advance the cause of justice. According to the police case, on April 7, 2010, a permanent naka at Roop Nagar near Police Station, Janipur, stopped a white Maruti car (JMU/Temp 1645) at about 4.45 pm,which was being driven by Tarun Kumar and the other accused was also sitting inside the car, subjected it to checking. Police recovered 300 grams of charas from the possession of Tarun and 1 kg 800 grams of charas from the co-accused. ASI Mohammad Akram prepared a docket in this regard and sent it to Janipur police station. On the strength of this docket, crime No 48/2010 for the commission of offence under section 8/20 of NDPS Act was registered against the accused and investigation was entrusted to DSP (P) Aftab Talib. On the conclusion of investigation, the case was challaned in the court.(JNF) |
