Nurse molestation case; High Court stays transfer of victim

Srinagar, Oct 31 : Jammu Kashmir High Court on Thursday stayed the relieving order of Nurse Molestation victim from a Primary health center and termed it unwarranted.
The petitioner, a staff nurse was working at Primary Health Center since April this year.
A single bench of Justice Mohammed Yaqboob Mir stayed the relieving order dated 17 October 2014 and issued a notice to Jammu and Kashmir government through Commissioner Secretary Health department, Director Health Service Kashmir, Chief Medical Officer Anantnag, Block Medical Officer Mattan and Medical Officer Primary Health Center Aishmuqam who have been respondents in the case.
Court also directed the respondents to submit their objection within two weeks.
The petitioner's counsel Advocate Altaf Mehraj pleaded before the court that the petitioner posted at PHC Aishmuqam was relived without any reason.
Court termed the relieving order unwarranted and kept the relieving order dated 17 October 2014 at abeyance.
Nurse molestation victim was earlier transferred from Seerhamdan hospital to Primary Health Center Ashimuqam when model code of conduct was in place.
Victim, who earlier this year accused director Health Services Kashmir, Dr Saleem-ul-Rehman, former Chief Medical Officer Anantnag Nazir Ahmad Shahdad, BMO Sallar Dr IsrahdTak and Assistant Medical surgeon Dr Ashraf.
Police which registered a formal against the accused later filled a closer report in the case saying that the scene of incident and statements of some eyewitnesses' prima faces negate the claims of victim, however the victims of 7th of August this year approached state High court through a petition challenging the one man enquiry commission that was constituted against the Supreme Court guidelines. Victim in the petition is demanding probe according to workplace anti-sexual harassment Guidelines and accordingly after the submission of the petition, court has issued notice to state government through through commissioner secretary health and medical education, director health services Kashmir and other accused doctors and had directed them to file objections with four weeks.
Victim on several occasions has also accused staff members posted in PHC Ashimuqam of harassing her during performing duties.
Victim on 17th of this month accused four doctors posted in PHC of harassing her and filled a complaint in police station Ashimuqam. Sources said that station house officer at Aashimuqam has forwarded the complaint of the victim to Chief Medical Officer with the direction to take action against the doctors.
Chief Medical officer Anantnag when contacted confirmed to Early Times that the department was probing the alleged harassment of the victim.
