Illegal constructions: HC directs DC Anantnag to constitute Complaint cell

Srinagar, Dec 22: The J&K High Court has directed Deputy Commissioner Anantnag to constitute within two days a Complaint cell in his office for registration of complaints regarding illegal constructions within 200 meters of river Lidder and prohibited area of Pahalgam in south Kashmir's Anantnag district. The panel, a Division Bench of Justice Muzaffar Hussain Attar and Justice Bansi Lal Bhat should be headed by Additional Deputy Commissioner or Assistant Commissioner.
The Deputy Commissioner, the Division Bench said, shall publish notice so as to inform people of Anantnag and adjoining areas that they can file complaints in case they find illegal structures are existent or coming in Pahalgam or within the 200 meters of Lidder. In another direction, the court directed Pahalgam Development Authority to inform it as how many structures exist within the radius of 01-50 meters, 51-100 meters and 101-200 meters on the bank of river Lidder identified from the Google Earth Map. "A bird's eye view would show that some structures are only three years old and have come on the banks of river Lidder within the radius of 05 meters, 07 meters etc.
The status report has been prepared on 16th August. 2014, but no action has been initiated in accordance with law against the violators," the court said and directed the CEO PDA and the Chief Engineer Irrigation and Flood Control Department to file fresh status report, indicating what action has been initiated against those persons who have raised constructions within 50 meters radius from the river banks.
The court also directed Member Secretary, State Pollution Control Board to file fresh status report, indicating as to what action has been taken against defaulting commercial establishments in light of laws governing environmental protection in Pahalgam. The court also directed that before the Competent Authority accords approval to the Master Plan, a copy shall be produced before the Court in a scaled cover.
