Shoddy Investigation leads to acquittal of three including husband in 'dowry death' case

Jammu, Sept 28: Principal Sessions Judge Udhampur R S Jain today has acquitted one Rajesh Kumar husband of deceased, Puran Chand and Kiran Mala (father-in-law and mother-in-law) of the deceased, as evidence falls short of the required standard of proof.
As per prosecution case against the accused Rajesh Kumar, Puran Chand and Kiran Mala is that on 9/3/2013, PSI Shafeeq Ahmed came back from GMC Hospital Jammu who presented statement of injured Santosh Kumari in the police station Ramnagar. The recorded statement od Santosh Kumari said stated she was married to Rajesh Kumar S/o Puran Chand R/o Ward No.4 Ramnagar about three years ago and has a son aged about 1½ years.
"Soon after the wedding, her husband Rajesh Kumar, mother-in-law Kiran Mala and father-in-law Puran Chand S/o Tola Ram started abusing her and to get Rs. 5 lakhs from her parental house otherwise they would finish her. "On 7/3/2013, in the evening she was at home when her husband and mother-in-law raking up the demand of dowry started fighting with her and beat her, statement of victim said, further adding, "thereafter her husband went to the market and came back home at late night at 12;00am and started to beat her again. Hearing her screams, her mother-in-law and father-in-law also came on spot and started to beat her. However getting the opportunity she telephoned her brother Ashu Gupta on Mobile and narrated the entire episode to him and meantime her husband took her outside and tied her with the rope while her mother-in-law alongwith victim's father-in-law having a common criminal intention sprinkled the kerosene oil on her and her husband set her on fire by a match-box. She became unconscious and when she regained conscious, she found herself in the hospital. She has heard the statement and is correct. After completion of investigation challan was presented and accused were acquitted by the Court after gone through the statement of witnesses and record. (JNF)
