Criminal proceedings initiated against HCC

RAMBAN, May 19: Criminal proceedings have been initiated against Hindustan Construction Company (HCC) for the dilapidated condition of Ramban-Banihal stretch of national highway, leading to fatal road mishaps.
The order to this effect was issued by Ramban district magistrate Mohammad Aijaz after HCC was found guilty of not carrying out repairs of the highway and non-compliance of instructions issued to it from time to time, official sources said.
"The dilapidated road has led to several road accidents, resulting in deaths of people," the sources added.
The work on 4-laning of the Ramban-Banihal road stretch from 150 km to 187 km was allotted to HCC under the condition that it would also properly maintain the existing highway. But even after warnings and instructions, the company did not pay any heed to the maintenance works. "The stretch is in a very dilapidated condition, having potholes, choked drains, lack of crash barriers, broken patches and slippage. All these factors are responsible for the fatal road accidents in the area," sources alleged.
In their official correspondence, Ramban's ADC and ARTO too have expressed serious concern over the worst condition of the road at locations like Marog, Battery Chashma, Ankoli fall, Digdole, Panthyal, Gangroo, Nachilana and Sherbibi where several fatal road mishaps have occurred.
Sources said the district magistrate had in the past convened a number of meetings with the company representatives, but the directions issued by him for proper upkeep of the highway were not implemented in letter and spirit.
Taking a serious note of non-adherence to his directions, which were otherwise aimed at checking road accidents and saving the precious lives of people, a notice was served on HCC for putting human lives in danger due to its careless and irresponsible working on the Ramban-Banihal road.
The district magistrate says in his notice that HCC's irresponsible way of maintaining the highway for a long period now, lives of people, including vehicle operators, have been put at risk and has led to public nuisance of the highest intensity which needs to be removed. "This serious nuisance is a criminal act on the part of HCC and needs to be proceeded under Code of Criminal Procedure," he added.
Exercising powers vested with him, the district magistrate directed HCC to show cause for blatant disobedience of "Maintenance Clause" of the contract agreement.
He also constituted a committee to quantify the repair cost of the Ramban-Banihal road which may be imposed as criminal liability on the company in case of occurrence of any untoward incident.
