HC directs SVO IGP to file ATR on findings of preliminary inquiry

Jammu, May 19: In a petition, seeking registration of FIR against three ex-Speakers of Legislative Sssembly (LA) for allegedly making 37 illegal appointments in the Assembly Secretariat, high court judge B S Walia today directed IGP of State Vigilance organization (SVO) to file action taken report (ATR) in terms of December 3, 2015 high court order through an affidavit before the next date of hearing.
On December 3, the high court had directed SVO IGP to take a final call in the matter in view of the preliminary findings of the vigilance organisation wherein it was established that no procedure was followed by the three ex-Speakers while making 37 appointments in the assembly secretariat.
It was concluded by SVO that 28 appointments were made by then Speaker Mohammad Akbar Lone, five by then Speaker Tara Chand and four by then Speaker Mubarak Gul. The SVO also found out that due procedure of law was not followed while making such appointments and only precedences were relied upon and appointments were made on pick and choose basis.
The petitioner's counsel drew the court attention to the status report filed by SVO IGP wherein it was divulged that after the conclusion of the preliminary inquiry, the matter had been referred to the law department for obtaining opinion in terms of J&K Government Business Rules looking into the questions of law involved in the matter.
He said the law department had, however, declined to give its opinion in the matter and requested SVO IGP to take a decision in the matter at his own level. He submitted that SVO was unnecessarily delaying the matter primarily for the reason that the three ex-Speakers were in the net and sought appropriate directions to SVO to take a final call in the matter.
The senior AAG, appearing for SVO, submitted that the final call could not be taken by the IGP as some more documents in the matter were supplied by the petitioner and a fresh complaint was also received by SVO in this matter from an RTI activist which was under probe.
After considering the submissions of both sides, Justice Walia observed that the senior AAG was not in a position to controvert the statement of petitioner's counsel and she "undertakes that in the eventuality of statement being correct, action taken by the IGP in terms of December 3, 2015 high court order would be placed on record by way of affidavit before the adjourned date of hearing, ie week commencing May 30 next".
