Police cop, dry fruit merchant acquitted as prosecution fails

Jammu, Dec 14 (JNF) : Principal Sessions Judge Ramban MA Choudhary has acquitted Waqar Ah-med Ganai a Police constable posted in CID SVK and Showkat Ahmed a Dry Fruit Merchant of Qazig-und who were facing trial in a NDPS Case, as prosecution miserably failed to prove its case.
According to the police case that on February 24, 2010 a Police Party headed by him as per the orders of the senior officers, Maruti Car No. JK02B/6850 coming from Srinagar was intercepted at hotel Shan Palace at 7:15 PM; two persons were found in the vehicle who disclosed their names as Waqar Ahmad a Policeman and Showkat Ahmad of Qazigund; on checking two white coloured polythene bags were recovered from them under each of the front seats containing cannabis like material wrapped in maize crop, Ramban Police registered a case vide FIR No. 23/2010 under section 8/20 NDPS Act.After investigation of the case and on receipt of forensic report the instant chargesheet was laid before this Court for the commission of offence punishable under section 8/20 NDPS Act against Waqar Ahmad Ganaie Police constable posted in CID/SBK R/O Badwa Gund Qazigund District Anan-tnag and Showkat Ahmad S/O Gh. Ali Parrey Dry fruit merchant Bus stand Qazigund R/O Shampura Qazigund District Anan-tnag (hereinafter called 'accused'). On denial of the charge by the accused the prosecution was directed to lead evidence.
While acquitting the accused persons, Principal Sessions Judge Ramban MA Choudhary after hearing GN Manhas Public Prosecutor appearing for the state whereas NA Pandit appearing for the accused persons, held that prosecution has miserably failed to bring home the charge against the accused. The prosecution case fails and is dismissed. Accused are acquitted of the charge. They are ordered to be released forthwith; from judicial custody provided they are not required in any other case.
