| DB takes serious note of functioning of GAD | | Encroachment of 92 Kanals of State Land by MP | | Early Times Report Jammu, Dec 19 (JNF) : In the much publicized Public Interest Litigation filed by Prof SK Bhalla highlighting organized land grabbing by certain police officers/ politicians/bureaucrats in connivance with land mafia/under world in various parts of Jammu/Samba Districts, A Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Hasnain Massodi took serious note of the functioning of General Administration Dept and said that this case reveals a tell tale story of poor administration by none else than the General Administration Dept. The matter pertains to recommendation made by Commissioner of Vigilance on April 24, 2006 recommending one Ch Lal Singh is in unauthorized possession of land measuring 92 Kanals 6 Marlas of state land which need to be got restored to the state. The recommendation April 24, 2006 has been placed on record. The aforesaid information was obtained by the petitioner under the Right to Information Act and the notice of the petition was issued to respondents vide order dated September 7, 2011. This significant dictated by Chief Justice for the Division Bench after hearing Advs V Bhat and SS Ahmed for the petitioner whereas HA Siddiqui AAG appearing for the state, observed that accordingly GAD is on notice, but no action taken report has been filed on behalf of respondents. DB took serious note and said that why no action has been taken is to be explained by the General Administration Dept and directed that let the reasons for maintaining blissful silence be explained in the status report, which may be filed within a week. The application filed through Adv Virender Bhat it has been submitted that despite the expiry of more than six years from the date of submission of report by the Vigilance Commissioner confirming the encroachment the same has not been removed as the occupant is highly influential being a Member Parliament and a former Health Minister of J&K. The local Revenue agency in District Kathua appears to be under pressure of the said occupant as in response to RTI Plea dated May 14, 2012, the Tehsildar Hira Nagar expressed complete ignorance about the encroachment in question and also took a U-Turn to the findings of the SVO. It is further submitted that Ch Lal Singh & his family are in possession of a huge chunk of land measuring 317 Kanals 16 Marlas at Village Karandi Khurd acquired through gift deeds and sale deeds by Smt. Kanta Andotra w/o of Ch Lal Singh and MS Kamia Andotra daughter of Ch. Lal Singh. According to petitioner the RB Educational Trust through its Trustee Smt Kanta Andotra is running Delhi Public School (DPS) from the aforesaid land and the said trust under the patronage of Ch. Lal Singh has built a huge farm house which is fully visible on spot. The petitioner has prayed that the state land measuring 92 Kanals and Six Marlas under the illegal occupation of Ch. Lal Singh be restored to the State and Principal Secretary to the Chief Minister be directed to file an ATR in the matter to apprise the Court about the steps initiated for retrieving the said land after the Vigilance Commissioner submitted his report in April, 2006. |
