Rigorous lifer to father, four sons in murder case

Jammu, Feb 19 (JNF) : Principal Sessions Judge Samba Kartar Singh today awarded rigorous life-imprisonment to Thoru Ram S/o Ram Dayal, Vikas Thappa, Parveen Thappa, Anil Kumar Thappa and Ajay Kumar Thappa s Sons of Thoru Ram Residents of village Dera Khidian, Tehsil Samba in murder case of one Jagdish Singh.
According to the police case on August 8, 2008 injured Sikander Singh stated that on 8.8.2008 at about 1 PM, Thoru Ram, Vikas, Parveen Kumar and Anil Kumar sons of Thoru Ram with an intention to kill them armed with Toka and stones, wrongfully restrained them and assaulted them on their head and other parts of the body and threatened that they would not leave them alive. He and his Jagdish Singh were grievously injured and on hearing their noise, some people came on the spot. The accused thought them to be dead and left the place. Those people took them to Govt. Medical College Hospital, Jammu for treatment. On the statement of the complainant Sikandar Singh FIR No. 98/2008 for the commission of offences falling under sections 307/323/341/34 RPC read with section 4/25 Arms Act was registered and investigation ensued. During investigation information was received on telephone from GMC Hospital, Jammu that the injured Jagdish Raj alias Thumka had succumbed to the injuries and on this information the offence under section 302 RPC was added and after completion of investigation challan was presented in the Court. Principal Sessions Judge Samba Kartar Singh today after hearing both the sides observed that it is true that Section 302 RPC mandates that whoever commits murder shall be punished with death or imprisonment for life and shall also be liable to fine. The accused are, therefore, sentenced to undergo rigorous imprisonment for life for the commission of offences falling under sections 302/149 RPC and pay fine of Rs. 5000/-each. In default of payment of fine, they shall further undergo rigorous imprisonment for a period of six months. The accused are further sentenced to undergo rigorous imprisonment for a period of seven years each for the commission of offence falling under section 307/149 RPC and pay a fine of Rs.1000/- each. In default of payment of fine, they shall further undergo rigorous imprisonment for a period of one month each. The accused Parveen alias Pintu and Vikas alias vikka are further sentenced to undergo rigorous imprisonment for two year each for the commission of offence falling under section 4/25 Arms Act and to pay a fine of Rs.1000/- each. In default of payment of fine, they shall further undergo rigorous imprisonment for one month each. Court further clarified that all the sentences run concurrently.
