| Court denies pre-arrest bail to 4 accused in kidnapping of minor | | | ET Report Jammu, Aug 6 (JNF): Principal Sessions Judge Kathua MK Hanjura has rejected anticipatory bail applications of Harbans Kour, Jatinder Singh, Inderpal Singh and Amandeep Singh in kidnapping of minor. According to police on 25 April 2012, the prosecutrix went missing. On enquiry it was found that she has been kidnapped by the accused and a case for offences u/s 363/109 RPC was registered at police Station, Kathua. After hearing Public Proseuctor Ravi Kumar Gupta for the state and advocates Ranju Verma and Deepak Sharma for the accused, the Court observed that a girl is alleged to have been kidnapped by the petitioners. "This has changed the entire complexion of the case. The law on the subject is clear. The grant of bail depends upon the nature of the offence, the manner in which it is committed and its impact on the society. Before parting it is saddening to note that the investigation of the case is going on at a snails pace. The occurrence dates back 25.4.2012. No attempt appears to have been made to secure the attendance of the petitioners before the investigating officer in this case of a hapless victim of kidnapping," with these observations Court denied pre-arrest bail to all the accused persons. |
