| Court acquits 2 women in abetment to suicide case | | | Jammu, Aug 6 (JNF): Principal Sessions Judge Poonch Kishore Kumar has acquitted Sagira Bi wife of Wazir Mohammad and Parvez Akhter wife of Munir Hussain both residents of Dingla, Haveli, Poonch who were facing trial in abetment to suicide case of one Shafayat Bi for the last eight years, as prosecution failed to prove the guilt of accused by cogent and clear evidence. According to the police Sarpanch Halqa Dingla, Mohammad Din informed telephonically to police station Poonch that one Shafayat Bi wife of Khadam Hussain had died due to consumption of some poisonous substance. The statements of the witnesses were recorded. The viscera was sent to FSL Jammu. In the proceedings u/s 175 of CrPC it was found that Shafayat Bi was being harassed by her neighbourers and relatives namely Sagira Bi, Pervaiz Akther and Ikhlaq Ahmed and alleging that she is having illegal relations with one Mohammad Ayoub. The Court after hearing Nazir Hussain Choudhary, public prosecutor and Anuj Kapoor advocate for the accused observed that the evidence direct as well as circumstantial evidence adduced by the prosecution and the legal position in the present case is such that the court can conclude with unerring clarity that the prosecution has miserably failed to bring offence home to the accused namely Sagira Bi and Parveiz Akhtar for causing the abetment of the deceased namely Shafayat Bi to commit suicide, punishable u/s 306 RPC. With these observations Court acquitted both the accused persons. |
