| Court acquits Postal assistant accused of misappropriation | | | Et Report Jammu, Aug 23 : Principal Sessions Judge Udhampur AK Koul has acquitted Prabhu Dass s/o Tej Ram R/o Martta Tehsil Ramnagar who was posted as Postal Assistant in Post Office Marta from Oct.2001 to 16.7. 2004 from charges of misappropriation of Rs 18100/-. According to the police case accused was posted as Postal Assistant in Post Office Marta from October 2001 to July 2004, during which period he was working as Saving Bank Counter Clerk. He received an amount of Rs.18,100 from Raghubir Singh on 6.7.2004 as monthly installments of 4 Recurring Deposit (RD) Account Nos. 48392, 48658, 49618 and 49619 but did not deposit the same in the Government Account. On the basis of this report accused was booked and investigation revealed that accused had misappropriated a sum of Rs.18,100/- received as deposits in aforementioned account numbers. During investigation some stamps, R D Registers and four pass books were seized by the Investigating Officer. Charge sheet against accused was produced before the Court. Principal Sessions Judge Udhampur Mr. AK Koul after hearing both the sides observed that that evidence on record is miserably short of proving that the accused was during the relevant period sitting on the saving account counter of the post office and was authorized to receive money, make the entries in the official record and remit the money to the government chest. It is also not proved convincingly that accused had dominion over the money which was allegedly defalcated. The prosecution has even failed to establish as to when the fraud if any was detected and the admitted prosecution version is that accused refunded the money back on 24.6.05. Thus, in the light of foregoing reasons, this case does not stand on sound footing. The accused has not been connected with the guilt as per the required standards. The case as such fails and is accordingly dismissed. The accused is acquitted.(JNF) |
