Early Times Report KISHTWAR, Aug 27: Dismissing the revision petition filed by the Home Department against the order passed by CJM Kishtwar directing the police to register an FIR against former Minister for Home in slap gate case, Principal Sessions Judge, Kishtwar, Pawan Dev Kotwal while citing the judgment of Allahabad High Court in Father Thomas vs State of UP has directed the police to register FIR and conduct the investigation as per CrPC. Pertinently, former Minister of State for Home Sajjad Ahmed Kitchloo had allegedly slapped the Chief Executive Officer Kishtwar Development Authority, Reyaz Ahmed Chowdhary forcing him to seek judicial intervention. The Court had expressed anguish over the incident of manhandling of one of the senior officers of the service by a Minister of State and had directed the Police to register an FIR against the accused. The Counsel for the complainant, Advocate Zulqernain Shiekh said that the court had reserved its judgment on Aug 13, as it could not pass it due to volatile situation in the region. "After hearing Public Prosecutor RK Goswami and going through the revision petition, Principal Sessions Judge observed, "the law laid down by Full Bench of Allahabad High Court in Father Thomas vs State of UP squarely applies in the present case. The Court observed that the present revision petition is not maintainable and is liable to be dismissed," he said. After the court judgment, former Minister has come in dock and an FIR would likely to be registered against him. "We have not registered an application in Police Station yet. We are going to soon approach the police station so that an FIR will get registered against National Conference leader Sajad Ahmed Kitchloo," Zulqernain said. |
