Jammu, Oct 22 : Principal Sessions Judge Jammu Kartar Singh has acquitted Shiv Kumar S/O Bishamber Dass who was facing trial in NDPS case as prosecution miserably failed. According to the police story that on 09.4.2009 incharge Police Post Parade Ground Jammu was on patrol duty along with other police constables and when he reached near No Entry parade ground, a person was stopped and checked. From his personal search, Charas was recovered which was seized on spot. He sent a docket to the police station and on this FIR No. 67/2009 for the commission of offence falling u/s 8/20 NDPS Act was registered and challan was presented. After hearing both the sides, Principal Sessions Judge Jammu Mr. Kartar Singh held that witness examined by the prosecution is Pardeep Kumar, SP, who has proved the fact that he was summoned on phone by the Incharge Police Post and he reached there and took the consent of accused for his search and from his search charas weighing 110 grams was recovered, which was sealed on spot. He had nowhere stated that who had sealed the charas and has also stated nothing about the presence of the SHO on spot and stated to have prepared the seizure memo as per the prosecution story and held that there is no even an iota of incriminating evidence against the accused. He is, therefore, acquitted of the charges framed against him. (JNF) |
