Delhi High Court gives major relief to J&K State Stays CERC order 10/22/2013 11:24:14 PM agencies New Delhi, Oct 22 : The Delhi High Court on Monday granted a major relief to Power Development Department of J&K State by staying the order passed by the Central Electricity Regulatory Commission New Delhi earlier directing the secretary Power Development Department to pay the unscheduled Interchange Charges of Rs. 75 crore by 25th of this month failing which the commission had warned that contempt proceedings will be initiated against the secretary Power Development Department.The state, through its standing counsel Suhail Malik challenged the order in Delhi High court on the grounds that the Central Electricity Regulatory Commission has failed to adhere to the principle of natural justice and that the order was bad in the eyes of law as the Central Electricity Regulatory Act 2003 does not extend to the State of Jammu and Kashmir as per the Article 370 of the constitution of India. The court after hearing the submissions and the forceful argument advanced by the standing counsel Suhail Malik stayed the order of Central Electricity Regulatory Commission, thus giving a major relief to the state of Jammu and Kashmir.   Share This News with Your Friends on Social Network     Comment on this Story
