| HC asks govt to file affidavit on conservation of Brari Nambal lagoon | | | Early Times Report
Srinagar, Oct 22: The J&K High Court today directed Secretary Housing and Urban Development Department (H&UDD) to file an affidavit indicating measures and suggestions for conservation of Brari Nambal lagoon of Dal Lake in Srinagar. A division bench of the court comprising Chief Justice M M Kumar and Muzaffar Hussain Attar said that affidavit should also depict measurements of the water body as well as measures taken for cleaning the lagoon. The bench also asked the Secretary H&UDD to inform the court as to how illegal constructions have come up on the peripheries of water body. On the submissions by advocate F A Mir for Srinagar Municipal Corporation that illegal constructions have been removed, the bench said, "Bear the burden if you have shoulders to bear them otherwise you will succumb." The court was also informed by Chief Engineer of Urban Environment Engineering Department through the status report filed by him that the Sewerage Treatment Plant installed at Brari Nambal has stopped functioning. He said department plans was working on a proposal to repair machinery of the STP at an estimated cost of Rs 4.36 crores. However during the course of the discussion, the court asked Vice Chairman LAWDA Irfan Yasin whether it is feasible to continue with the repair of the STP or have it replaced by new one. The Vice chairman stated that a complete status report and report of experts, preferably from National Environmental Engineering Research Institute (NEERI) shall be filed by next date of hearing. "We feel that instead of spending amount on repairs, it would be better to purchase a new one," the division bench said. The court, hearing a Public Interest Litigation about Dal Lake the saving, also deferred orders on relocation of house boats. The bench also asked government to inform the court whether it wants to retain the incumbent vice chairman LAWDA Irfan Yasin or some other officer will be replacing him soon he demits the office. "It has also been pointed out that Mr Yasin, vice chairman LAWDA is completing his term on 3 March 2014," the court said and added, "This requires immediate association of an officer at this stage so that by the time Mr Yasin demits his office, the officer shadowing him may be ready." Advocate General M I Qadri said that the Irafan Yasin will be either retained or replaced by a "competent and totally devoted officer." “Let the needful be done within four weeks," the court said, directing government to file status report by next date of hearing. |
