12 yrs RI , fine imposed upon accused in 'minor's abduction , rape case'

Jammu, Nov 5 (JNF): Principal Sessions Judge Poonch has awarded 12 years rigorous imprisonment and fine Rs 10,000 to accused who was facing trial for the last 10 years in a case of kidnapping and rape with a minor girl.
Principal Sessions Judge Poonch Jaffer Hussain Beigh after hearing Advocate Mohinder Pyasa for the accused whereas Public Prosecutor Choudhary Nazir Hussain for the state observed that the accused Mohd Jahangir Khan S/O Banka Khan R/O Shahpur Tehsil Haveli District Poonch, was convicted for commission of offences punishable under sections 363 and 376(1) RPC. The Court sentenced accused, to undergo rigorous imprisonment for seven years and to pay a fine of Rs.5000/- and in default of payment of fine he shall further undergo imprisonment of like nature for 6 months for the commission of offence under section 376(1) RPC, also to undergo rigorous imprisonment for five year and to pay a fine of Rs.5000/- and in default of payment of fine he shall further undergo imprisonment of like nature for six months for the commission of offence under section 363 RPC. Both the sentences of rigorous imprisonment shall run concurrently. The accused be lodged in Central Jail Kote Bhalwal Jammu for undergoing the above said sentences imposed upon him. According to the case that father of the prosecutrix lodged a written report the accused with the aid of six other persons kidnapped his minor daughter aged about 15 years at 8.00 am on 18th November 2003 and have taken to unknown place as the accused intended to get Married with the prosecutrix. On this FIR No.163 of the year 2003 for commission of offence u/Ss 376/363 RPC stood registered in Police Station Poonch and during the course of investigation police recorded the statement of the witnesses conversant to the facts, recovered the prosecutrix and arrested the accused, referred them for medical examination. After completion of the investigation offences u/s 376/363 RPC were established against the only accused Mohd Jahangir Khan and the challan was presented before the court.
