| DB directs strict action against 'polythene ban' violators | | | S Sabaqat
Srinagar , Nov 5: Expressing its concerns over the unabated use of polythene despite blanket ban in the state, a Division Bench of J&K high Court today directed authorities concerned to take stern action against the violators. Passing slew of directions while hearing a Public Interest Litigation (PIL), the division bench comprising Justice Mohammad Yaqoob Mir and Justice M H Attar directed all the District Magistrates to make public through print and electronic media that "polythene if found and seized from any shopkeeper or stockist, they shall have to face consequences and contempt of court proceedings shall be initiated against them for violation of court orders." "The object of above mentioned PIL is to eradicate the menace of polythene from the territory of the state, court observed further adding time and again number of directions have been issued whereas compliance reports, as filed from time to time, suggest a very horrible state of affairs and despite all measures taken by the state government. "Despite repeated directions from this court, violations are unabated," the court observed and directed authorities to display signboards at the entry points at Lakhanpur and Lower Munda to the effect that any vehicle carrying polythene and polythene bags shall be dealt with under law and owners and drivers shall be liable for contempt of court. "Henceforth, any vehicle seized for carrying polythene and polythene material shall not be released until further orders of court. The violators shall be sternly dealt with for violating the court directions and the law," court said. In wake of huge recovery of polythene carry bags in the state and to ensure effective tax collection, on the last date of hearing, the J&K High Court had asked government to review whole system of checking vehicles at Lakhanpur besides underlining that since Jammu and Kashmir is blessed with natural beauty and large number of water bodies, the use of polythene is causing huge damage to its natural ecology. Meanwhile, the court also directed all the District Magistrates to intensify the checking and said that in the process when polythene bags are seized from the shopkeepers or the stockists, their particulars shall be submitted along with the status report so that they can be proceeded against for violating the court directions. |
