| Reservation rules flouted; eligible for MBBS, candidates given BDS option | | No end to saga of injustice by BOPEE | | Avinash Azad Jammu, Nov 28: As the Board of Professional Entrance Examination (BOPEE) continues to be mired in plethora of irregularities committed in CET followed by 'unfair' selection of candidates in various professional courses, more skeletons have started tumbling out of the cupboard loaded with alleged malpractice in the MBBS entrance exam for the year 2013. The controversy this time has arisen out of a fact that has been brought to the fore by some candidates at the receiving end due to 'wrong' rather (mis)interpretation of the Rule 17 of SRO 294 of 2005 pertaining to allotment of seats under reserved categories. The point has been contested by some applicants who instead of getting their chosen stream of MBBS as first priority have been alloted seats for BDS course despite being eligible for selection in MBBS under the categories they had applied and opted. The contesting applicants include Syeda Saba Fatima age 20 years, daughter of Nisar Hussain Shah resident of Village Potha Teh. Surankote district Poonch A/P 355EP Mohalla Dalpatian Jammu and Priya Bakshi age. 19 years, daughter of Ravinder Kumar resident of Kallar P/o Dalogra Teh. & District Rajouri. The aggrieved candidates crying foul have alleged gross irregularity and misue of official position by Chairman R.D. Sharma, Farooq Ahmed Mir, Controller, Ishtiaq Ahmed, Deputy Secretary Legal and other officials even as they are said to have given some 'extraneous reasons' to justify their acts of ommission and commission. The aggrived have contended that vide Notification No. 32-BOPEE of 2013 dated 05-08-2013, the BOPEE issued the list of short listed candidates and in the said list applicant No.l figured at serial number l under JKPM Category amongst the female candidates for Medical Course (MBBS) whereas the name of the applicant No. 2 was figuring at S.No. 5 under CDP Category for the said Course. Pertinent to mention here is that applicant Syed Saba Fatima was the most meritorious female candidate selected under JKPM category for Medical course. Also pertinent is the fact that JKPM (i.e. Son/Daughter of Police Personnel) category carries a reservation of 1% and that of CDP (i.e. Son/Daughter of Defence Personnel) carries a reservation of 3%. These are the hard facts around which the aggrieved make a strong plea of their cases for justice. What happened during the period of selections is something which shows fishy and shady procedural tactcis. The candidates who were short listed and were recommended for provisional admission were called for counseling and the applicants appeared in the said counseling which was scheduled on 21-08-2013 before BOPEE at Srinagar. However, much to their shock, during counseling the applicants were astonished to know that their names have been kept for BDS in Indira Gandhi Govt. Dental College, Jammu notwithstanding the fact that the applicants were entitled for admission to MBBS course at GMC, Jammu/Srinagar as per their preference and availability of seats as was shown in the matrix sheet dated 19-08-2013. What makes the whole story explain the chain of wrongdoings is a step by step detail churned out by the candidates. On 20-08-2013 the candidates falling in open merit of JKPM and CDP categories were called for counseling by the BOPEE authorities and in the light of Rule 17 of SRO 294 of 2005 dated 21-10-2005, the said candidates were allotted MBBS course at GMC Srinagar/Jammu. As per the said rule a reserved category candidate, if selected against the Open Merit seat, may be considered for allotment of discipline/ stream/college applicable to him in his respective category on the basis of his merit and preference. The resultant discipline/stream/college in the Open Merit Category shall be allotted to the reserved category candidate who gets selected consequent upon the reserved category candidate getting selected in the Open Merit Category." However, the entire concept and definition was systematically defeated and slaughtered by those at the helm, apparently to favour others over the deserving.” Consequent upon the first round of counseling for allotment of discipline/institution of short listed candidates the BOPEE vide Notification No.36- BOPEE of 2013 dated 23-08-2013 issued Provisional Select List for admission to MBBS, BDS and Diploma in Dental Hygiene courses as per their merit, choice and availability of seats. However, at the time of the counseling the applicants who were required to be allotted MBBS course were compelled to opt for BDS course due to the so-called non-availability of MBBS course in their respective category which resulted due to misinterpretation of Rule 17 of SRO 294 of 2005 dated 21-10-2005 by the BOPEE. And apparently in view of the interpretation of rule 17 the category candidates who were falling in open merit had exercised their right of preference in respect of stream /college and accordingly they were allotted MBBS course in their respective colleges in the light of Para first of rule 17. However, the second Para of the said rule where it is categorically mentioned that the resultant seats-shall be allotted to the category candidates falling next in order of merit. It is worthwhile to mention here that had the candidates falling in open merit belonging to categories would not have availed the provision of rule 17 they would have been placed in MBBS category at SKIMS Srinagar, which clearly indicates that these candidates had vacated two seats of MBBS at SKIMS Srinagar which ought to have been allotted to the applicants falling next in order of merit amongst the female candidates. Whereas, by way of misinterpretation of rule 17 and for extraneous reasons the BOPEE authorities have infringed the right of the applicants and allotted to them BDS. This act of the BOPEE authorities has not only made the meritorious and hard working applicants to suffer a lot but brings to fore one more irregularity and unfair means in making selections, for which it is already in dock.
