| Information of Union Minister's cousin, other details denied | | CIC summons ARC New Delhi | | Sumit Sharma
JAMMU, Nov 28: Disappointed over under estimating Jammu and Kashmir RTI Act 2009, Chief Information Commissioner (CIC) has summoned Additional Resident Commissioner, New Delhi, who also happens to be the PIO.
The direction for his appearance came to effect after RTI activist Balwinder Singh filed second appeal before commission seeking strict action against PIO and high level probe as well be initiated for denial to divulge the information. Earlier, CIC had directed ARC twice to attend the hearing but he ignored.
Acting tough, Commission in its order No SIC/co/Temp No /117/2013 wrote "Where as, in pursuance of section 32 of the Code of Civil Procedure Samvat 1977, penalty for default of appearance can be imposed for failure to attend the Commission on the date of hearing; and Whereas, the complaint is now fixed for hearing on 13-12-2013 at 11:30 am before Chief Information Commissioner, at Jammu office."
The order further adds "Now, therefore, you are hereby directed to appear before the Chief Information Commissioner on above date of hearing at Jammu Office of the Commission for hearing of the case .In case you fail to cause your appearance on eh said date and time, the Commission will proceed against you in pursuance of section 32 of the C ode of Civil Procedure Samvat 1977."
Balwinder filed RTI query seeking details regarding procedure adopted for booking of rooms in the two JK Guest House running in New Delhi at Chankyapuri and Prithvi Raj Marg, photocopies of booking for last 2 years, name of AEE posted, his date of joining and his rank when he was posted there. It is alleged that the AEE who is managing the affairs at JK Guest House, New Delhi is posted there since the last more than 18 years.
He was first posted there as JE and being cousin of one of the Union Minister from Jammu and Kashmir continued to stick there to provide hospitality to blue eyed only.
RTI activist filed RTI before commission on December 2012 but he did not receive the information even after elapse of one year. PIO earlier harassed him on various false pretext and undermined the RTI Act 2009 by pointing various false lacunae. |
