Allow inspection of documents by RTI applicant: SIC to DSE Jammu

JAMMU, Dec 17: The State Information Commission (SIC) has directed the Directorate of School Education Jammu to allow an RTI applicant from Doda to undergo inspection of the documents pertaining to Rehbar-e-Taleem teachers of Gundna zone of Doda district.
As per details available one Kishore Kumar son of Suram Chand a resident of Village Korari Prem Nagar, Doda moved an application under RTI Act dated 03-05-2013 before the Public Information Officer (PIO), Director School Education, Jammu wherein he sought Year Wise detail of Rehbar-e-Taleem engaged in New Primary and upgraded Primary Schools in Education Zone Gundna w.e.f. 2000-2013;
Detail of R.E.T Teacher selected on the basis of habitation w.e.f. 2000-201 in Education Zone Gundna;. Detail of 3rd Teacher selected in Education Zone Gundna w.e.f. 2000-2013; Detail of EV's selected in EGS centres in Education Zone Gundna w.e.f 2000-2013; Detail of Contractual Teacher selected in Education Zone Gundna w.e.f. 2000-2013; Provide certified copies of habitation certificates of R.E.T Teachers who are selected on the basis of habitation Zone Gundna w.e.f 2000-2013; Stay of the officer/official in CEO office Doda; Sanctioned strength of CEO Office, Doda; List of the staff attached in CEO office Doda.
The PIO, Directorate of School Education, Jammu vide letter no. DSEJ/RTI/2013 dated 06-05-2013 transferred the RTI application of the applicant to Chief Education Officer (CEO) cum PIO, Doda. Feeling aggrieved of inaction on the part of the CEO/PIO, Doda, the information seeker preferred 1st appeal before Director School Education, Jammu. The FAA cum Director School Education Jammu directed the CEO/PIO, Doda to provide the requisite information to the information seeker within a week's time. The appellant filed 2nd appeal before the State Information Commission (SIC) and alleged that no information was provided by the CEO/PIO, Doda.
The SIC, in its order ruled " During the course of proceedings held today (Dec 9th, 2013), the PIO/District Education Planning Officer (DEPO) , Doda apprised the Commission that the information as requested by the information seeker was sent to him under registered cover on 04-12-2013. The PIO also explained the delay which was due to misconception as the information seeker had earlier also filed an RTI application in the month of January, 2013 which was answered vide office No. CEO/D/Monitor/37760-61 dated 28-01-2013 and again vide office No. CEO/D/RTI/11567-69 dated 18-07-2013. Thus, there is no intentional delay or malafide on the part of PIO in providing the information to the information seeker. The information seeker acknowledged the receipt of the information and requested the Commission that he would like to inspect the record and may be allowed an opportunity to do the same"
The SIC directed the PIO to provide an opportunity to the appellant to inspect the record in his office on a working day during office hours and also provide him the certified copies of the relevant documents if any, required by the appellant. Parties are at liberty to settle the date and time for inspection of record which may be convenient to them.
