Court awards 18 years RI, Rs 1 lakh fine for raping minor

Jammu, Feb 25 (JNF): Presiding Officer Sanjeev Gupta today awarded 18 years rigorous imprisonment and fine Rs 1 lakh to one Pashori Lal s/o Prthivi Raj in minor rape case.
According to the police on April 10, 2009 Arun Jamwal then SHO P/S Nowabad was on a routine patrol duty, he received source information about a stationary Ambassador car parked in suspicious circumstances near Temple having its tinted glasses rolled-up. On reciving this information SHO Arun Jamwal went to spot and during checking the car prosecutrix and accused were found present inside in naked condition and after ascertaining their identities, statement of prosecutrix was recorded who disclosed that she had a quarrel with her step-mother in the morning due to which she left her home in despair and proceeded towards Bus-Stand, Jammu on foot in order to visit the house of her maternal uncle, however, when she was drinking water from a hand-pump after reaching near stadium gate at about 11:00 AM she saw accused standing near a white ambassador who made an enquiry from her and she narrated the entire story, she further alleged that since she was not carrying any money, therefore she fell in the trape of the accused who enticed and lured her to sit inside his car with the assurance that he will drop her at her maternal uncle's house and threatened her and rape her without consent. On this police registered a case and after completion of investigation challan was presented. Today after hearing APP GS Charak for the state whereas Adv Prince Khanna appearing for the accused, Presiding Officer Fast Track Court Mr. Sanjeev Gupta convicted the accused u/s 376/363/342 RPC and awarded the accused to go rigorous imprisonment of 12 years and fine Rs 1 lac u/s 376 RPC, u/s accused was sentenced to undergo rigorous imprisonment for a period of five years aand fine Rs 5000/- and u/s 342 RPC he is sentenced to undergo rigorous imprisonment for one year and fine Rs 1000/- Court further clarified that all the sentences shall run concurrently.
Court further observed that in case fine amount will be realized from convict, then an amount of Rs one lac shall be paid to victim as compensation.
