Construction of school buildings under SSA in Udhampur
SIC directs CEO to provide Information free of cost

Jammu, Mar 3 : The State Information Commission (SIC) has directed the Chief Education Officer (CEO) Udhampur to provide information related to construction of school buildings in the district free of cost to an applicant .
The CEO office had earlier denied to provide the said information to the applicant and the matter landed in SIC after the applicant filed second appeal in the commission.
One person namely Sham Lal S/o Amar Nath R/o Sear Majla, Tehsil Ramnagar, District Udhampur moved an application dated 07- 08-2013 before the PIO /Directorate of School Education, Muthi Camp Jammu under J&K RTI Act, 2009 where-under he sought certain information regarding the status of construction work of school buildings under SSA scheme etc. The PIO/Directorate of School Education, Jammu transferred the application of the information seeker vide office letter No:DSEJ/RTI/2013/6519 dated 04-09- 2013 under section 6(3) of the RTI Act, 2009 to the PIO/CEO Udhampur for further necessary action at his end followed by a reminder dated 28-10-2013.
The information seeker also preferred Ist appeal before the First Appellate Authority (FAA) ie Directorate of School Education, Jammu.
After that appellant knocked the doors of the State Information Commission (SIC) by filing second appeal dated 31-12-2013 in which he has alleged that PIO has not provided the requisite information sought by him in his RTI application. The Commission after receiving the second appeal, listed the matter for hearing on 19-02-2014 at Jammu office of the Commission.
Both the parties were present at the time of hearing . During the course of proceedings, Dy. Chief Education Officer, Udhampur submitted before the Commission that the appellant had earlier filed an application dated 13-02-2013 and requisite information was sent to him twice vide office letter No:CEOU/RTI/32077-79 dated 20-03-2013 and CEOU/RTI/4441- 43 dated 04-05-2013 under a registered cover and these were returned by the postman with the remarks recipient refused to receive the registered letter. "
In view of the past conduct of the appellant, the PIO requested the Commission that the appellant be directed to personally collect the information from the office of the CEO Udhampur. In view of the aforesaid facts and observations, appellant is directed to collect the information personally from the office of PIO/CEO Udhampur .
The PIO is also directed to hand over the information to the information seeker free of cost as requested by him in his RTI application" reads the SIC order.
