Non- payment of compensation to Kishtwar riots victim
SCDRC issues notices to Bajaj Allianz Ins Co

JAMMU, Apr 1: The J&K State Consumer Disputes Redressal Commission, Jammu comprising of Justice (retd) B A Kirmani and D K Kapoor (retd Distt Judge) Member has issued notice to the Bajaj Allianz General Insurance Co. Ltd in a complaint filed by one Aasia Aslam wife of Asif Iqbal Sheikh Proprietor of M/s Royal Ladies Corner Kishtwar.
In the complaint filed through Advocates A K Sawhney and Aseem Sawhney, the woman complainant Aasia has sought a direction from the Consumer Commission to the Insurance Co. to pay a sum of Rs 10 lacs as insurance with Rs 5 lacs as loss of business, torture, agony, harassment and bank interest on loan and Rs 1 lac as litigation charges totalling upto Rs 16 lacs.
The complainant started her shop with the name and style- M/s Royal Ladies Corner and started running the business from 22nd July 2013 onwards regularly and sales and purchases being made regularly.
She further submitted, since the complainant had availed a Bank Loan, therefore under the norms of the Banking Operations, the J&K Bank impressed for the insurance of the Shop of the complainant, for which the complainant paid premium of Rs 5818 to the Bajaj Allianz Ltd- OP. The said payment was made on 17th June 2013 and the said entry is reflected in the Bank Statement of the firm account of the complainant. The cover note and policy were issued under the Shopkeepers Package, with the Policy no. DG-14-1204-4092-00005975. The Policy covered the period from 25th June 2013 to 24th June 2014 midnight.
A catastrophe struck the complainant when on the unfortunate day of 9th August 2013, there was mayhem and riots in Kishtwar town, and some miscreants torched, arsoned, burnt and looted the shops of both communities there. In the said mayhem, the shop of the complainant was also burnt and looted and in this connection the shop and the material was looted.
The complainant in this connection informed the OPs - Insurance Company and the form was got filled by the officials of the OP and the Surveyor of the OP in the month of August 2013 itself.
From August 2013 till February 2014 the complainant and her husband kept running from pillar to post for finalization of the claim and release of the insured amount for the loss of the complainant but the OPs are negligent in doing so.
That despite providing all the documents, including Govt Assessment report and Police Final report still the Ops are delaying the matter on false pretexts, it was alleged in the complaint.
On hearing the submissions advanced by the counsel for the complainant the Commission issued notice to the OPs- Bajaj Allianz Insuarnce Co. Ltd and directed them to file their written version.
