| HC issues notice to Secretary Law, Registrar General High Court | | Sessions Judge challenged his compulsorily retirement | | Early Times Report Jammu, May 19: In a petition filed by then District & Sessions Judge Brij Mohan Gupta challenging his compulsory retirement, Justice Tashi Rabstan of J&K High Court Jammu Wing today after hearing Sr. Adv Sunil Sethi with Adv Vaibhav Gupta appearing for the petitioner issued notice to State of J&K through Secretary law, Justice & Parliamentary Affairs and Registrar General of J&K High Court returnable within two weeks, Court also permitted Dasti Notice. Justice Tashi Rabstan directed Registry to list this petition immediately after completion of service. In the petition filed by Brij Mohan Gupta seeking appropriate direction order and declaring Govt Order No 08-LD9A) of 2014 dated January 1, 2014 issued by Secretary law sanctioning the compulsory retirement of the petitioner on the basis of the recommendations made by the Registrar General of J&K High Court vide communication No 3271/GS dated June 11, 2013 being totally illegal and against the provisions of law. The petitioner has further challenged the communication No3271/GS dated June 11, 2013 issued by Registrar General J&K High Court recommending compulsory retirement of him being total illegal.The petitioner prayed for directions to the respondents to allow the petitioner to complete the service up to 60 years and also grant all consequential benefits in favour of the petitioner.
