FIR against DySP Shashi Thakur turns into hotchpotch
Case submitted to Jammu SSP as not proved but investigation is still in progress, court intervenes

Jammu, Sept 27: The FIR against DySP Shashi Thakur has become a hotchpotch as the case has been closed as not proved and submitted to SSP, Jammu, for perusal, but its investigation is still in progress for final report.
The revelation has been made by Asstt. Superintendent of Police, SDPO, City West, Jammu who was directed to file counter statement by State Information Commission. In compliance to the direction of the Commission, the counter statement was filed vide office letter No 12457/SDCW dated 05-08-2014 in which he stated interalia that the case in question is lying under investigation with the SDPO City West, Jammu by the orders of SSP, Jammu. Moreover, investigation in the above referred case has been stayed by the High Court, Jammu in petition 561 No 411/2013 Cr.M.A. 501/2013 titled Shashi Thakur versus State of J&K and others.
The statement on the part of police came to limelight when Dr R.P Singh,Retd Chief Medical Officer R/o F34-A Lane No. 06, Talab Tillo, who happens to be the husband of the DySP Shashi Thakur, moved an application before the Public Information Officer O/o DIG Range, Jammu under Jammu and Kashmir Right to Information Act, 2009 where under he sought the copy of enquiry report conducted by SSP, Jammu and final report of investigation conducted by the then Dy.SP Hqrs. in case FIR No. 100/12 P/S Channi Himmat, Jammu entrusted to them by the then worthy DIG Range, Jammu Vide his order no. CB/RPHQJ/9686-92 dated 24-11-2012 on request/representation of his wife Shashi Thakur, DySP JKAP-4th Bn. Security, Jammu. Besides, he also sought the details of actions taken by various concerned officers and officials on these final reports given by the above said officers.
Earlier also, the PIO/Dy. Supdt. of Police, Hqrs. Jammu vide office no. RTI/2013/160/3064-65 informed that the case FIR No. 100/2012 u/s 447/323/506 RPC P/S Channi Himmat, Jammu closed as not proved and submitted to SSP, Jammu for perusal. The case has not been closed at SSP level and sent for further necessary action to SDPO City West, Jammu. After conclusion the final report shall be prepared.
The Commission in its judgment observed, " Petitioner has sought the quashment of FIR No. 100/2012 registered with Police Station, Channi Himmat, Jammu but the High Court has only stayed it to the effect not to be finalized till next date before the bench.It means that till the FIR is quashed by the High Court, it has been kept in suspended animation and can revive subject to the outcome of the order of the court. Hence, in view of Section 8(1)(g) which grants exemption from disclosure of information which would impede the process of investigation or apprehension or prosecution of offenders dissemination of information at this stage is not permissible".
