Jammu, Oct 4 : Principal Sessions Judge, Kathua, Vinod Chatterji Koul today awarded six years rigorous imprisonment to Som Nath and Subash Chander, sons of Badhawa Ram of Chhan Rorian in Hiranagar, Kathua, who were facing trial in an attempt to murder case for the last five years. According to police case, an oral report was made on 10.02.2007 by the complainant that Som Raj, Madan Lal and Subash Chander, all sons of Badhawa Ram, having an old enmity with the victim, with the common criminal intention trespassed into his house and attacked his mother with Darat and lathies with intention to kill her. Som Nath and Subash Chander were armed with Darat. Som Nath hit his mother on the head with the darat but she in order to save herself from attack raised her right arm due to which she received grievous injury on her arm. Thereafter Subash also attacked her with darat and this time she received the blow on her left arm. Due to the said attack, she fell down on the ground. Other accused started beating her with fists, blows and lathies. On raising cry all the accused fled away from the spot. The complainant was also assaulted by the accused Thoru Devi and Madan Lal. On this report, police registered FIR No 240/2007 for offences punishable under sections 452, 307, 325, 323, 201 and 34 of RPC and after completion of investigation challan was presented. After hearing both the sides, the judge observed that keeping in view all the facts and circumstances and while balancing the aggravating and the mitigating circumstances, the ends of justice will be met in case both the accused Som Nath and Subash Chander are sentenced to undergo rigorous imprisonment for a term of six years and also to pay a fine of Rs 3,000 each for commission of offence punishable under section 307 of RPC and in case of default in paying the fine, accused shall undergo further imprisonment of three months each. They are further sentenced to undergo imprisonment for a period of three years and a fine of Rs 1,000 for offence punishable under section 452 of RPC each and in case of default in paying the fine, accused shall undergo further imprisonment of one month each. Both the sentences, however, shall run concurrently. (JNF) |
