HC stays transfer of Tehsildar Assistant Returning Officer | | | Jammu, Nov 5 : In a petition filed by Ch. Mohd. Nawaz Tehsildar who was also appointed as Assistant Electoral Registration Officer Nowshera challenging his premature transfer, Justice Bansi Lal of J&K High Court Jammu Wing after hearing Adv AM Malik appearing for the petitioner, issued notice to the respondents and ordered that respondents to consider the case of the petitioner being retained at Nowshera in view of the circular 44 of GAD of 2014 relating to the norms laid down by the Election Commission of India with regards to appointment of Returning Officer/ Assistant Returning Officers and pass appropriate orders and till the petitioner shall be retained at present place of posting. In the petition, petitioner seeking quashment of Govt. order No.Rev/Gaz/ 261 of 2014 dated 29-10-2014 qua the petitioner whereby the petitioner in violation of the instructions issued by the Election Commission of India and also in violation of transfer policy in vogue was transferred from Tehsil Nowshera to Tehsil Kharaballi. In the petition, petitioner also submitted that the the Chief Electoral Officer of J&K had issued the list of Assistant Electoral Registration Officers which is available on his official website whereby the petitioner has been nominated/designated as Assistant Electoral Registration Officer in 81-Nowshera Constituency falling in Tehsil Nowshera.
