If Parliament can't abrogate Article 370 why clamour from PDP, NC & Congress? | | | Early Times Report JAMMU, Nov 29: If senior PDP leader and a prominent constitutional expert, Muzaffar Hussain Baig, is to be believed there is no way open for either the Government of India or for the state Government to abrogate Article 370. Discounting the possibility of the scrapping of Article 370 which grants special status to Jammu and Kashmir, the PDP leadership has said the Constitution of India itself was a safeguard against any such attempt. There is no way Article 370 can be done away with without snapping the constitutional ties between the state and the Union," PDP MP and former Deputy Chief Minister Muzaffar Hussain Baig has said Explaining the context of Article 370 and the special position granted to the state, Baig said it was no concession to Jammu and Kashmir but a recognition of the distinct historical, cultural and ethnic status of the erstwhile princely state which had decided to throw its lot with a democratic India at the time of Independence. He has said the Article had virtually assumed a permanent status as it could be scrapped only through a resolution by the constituent Assembly of J&K which had ceased to exist long back. The PDP patron, Mufti Mohd. Sayeed too has said that even the Parliament cannot scrap Article 370 which actually defines and shapes centre-state relations. Even the National Conference leadership, has voiced its opinion on the state's special status. Chief Minister, Omar Abdullah, and the NC President, Farooq Abdullah, have stated, on a number of occasions, that Artcile 370 cannot be abrogated. Farooq has gone to the extent of saying that if Article 370 was scrapped Kashmir could become part of Pakistan. Well he may not be correct in nursing such an impression but the main idea behind his outburst has been to unnerve those who plan to abrogate Article 370 of the Constitution of India. The state unit of the Congress is also opposed to any move to either abrogate Article 370 or dulute the spirit of the special status granted by the Article. However, interesting part of the Congress scheme is that it has been voicing opposition to any move to scrap Article 370 during the election period in the Kashmir valley and avoids speaking on the issue while campaigning in the Jammu region. However, this time the PCC chief, Saif-ud-Din Soz, has reacted sharply against any move on scrapping Article 370. He has said that the basis of state's accession with India is Article 370 and if this Article was abrogated state's accession with India will end. Now the question being posed by people to the NC, PDP and Congress leaders is why there is clamour over the move to abrogate Article 370 when there is no way for doing so? If neither the Parliament nor the state Government can repeal this Article why then the noise ? Are voices opposing moves to scrap Article 370 meant to keep the vote bank in tact ?Yes it seems so because what is more interesting is the way the PDP and the NC leaders resort to breast beating over the reported moves of the Government of India to do away with the special status that Jammu and Kashmir has been enjoying. Where is the move ? Who is the author of this imaginary move? And if anybody can initiate steps for abrogating Article 370 it can be Prime Minister, Narendra Modi. But hitherto, after having become Prime Minister of India, Modi has never talked about his plan on abrogating Article 370. Even while campaigning for the Lok Sabha election he had stated that there was need for a debate on the issue for finding out whether Article 370 had benefitted people of Jammu and Kashmir or not. If it was found that people were benefitted under this Article it will stay. If PDP and NC leaders are 100 per cent sure that there is no way available for Modi to abrogate Article 370 why should they rake up such issues? For change let the PDP and the NC forget about Article 370 and instead plan for carrying out development schemes for progress in industry and agriculture. Again it seems to be part of poll politics. Now that the BJP's poll manifesto is silent on Article 370 the NC, PDP and the Congress have been heard crying loud whie blaming the BJP for this U-turn. These three mainstream parties should have appreciated if the BJP has not touched Article 370 issue in its poll manifesto. |
