Court acquits Patwari; directs IG crime to take action against IO
Alleged tampering of Revenue Record

Jammu, Dec 9 : In a major set-back to Crime Branch in which special Judge Anticorruption Mr. Sanjay Dhar acquitted Patwari and other for allegedly changing Revenue record , the court directed Inspector General of Crime Branch to proceed against the Investigating officer after seeking explanation from him. According to Crime Branch case, complainant Suraj Singh and accused Balbir Singh are real brothers and their ancestral property stands portioned since long pursuant to the complainant and the accused Balbir Singh and it is further alleged that land situated at Village Ghou Manhasan is shown under cultivation of complainant Suraj Karan Singh and Balwan Singh whereas Patwari Suraj Parkash then Patwari in connivance with Balbir Singh made insertion in revenue record . On this Crime Branch registered a case and after completion of investigation challan was presented. Special Judge Anticorruption Jammu Mr. Sanjay Dhar after gone through the case and hearing Advocates Ashok Mishra and MM Gupta for the accused persons, observed that it is not a cased where exclusive possession of complainants has been struck off and in its place possession of accused Balbir Singh has been reflected and further observed that investigating agency has not referred these insertions for opinion of handwriting expert nor has it record the statements of the persons who are acquainted with the handwritings of patwaries who were posted in the concerned Patwar during the relevant period and this is a lacuna which has proved fatal to the prosecution case for thus the responsibility lies solely with the investigating officer for which he owes an explanation.
With these discussion, it is evident that the prosecution has failed to establish the charges against the accused and dismissed the charge-sheet and acquitted of the charges and forwarded a copy of judgment to IG Crime Branch with a direction to proceed against the investigating officer after seeking an explanation from him in the light of observations.
