Court awards three year imprisonment to Bus Driver | Road mishap resulting in death of 26 | | Jammu, Dec 9 : In a major accident in which 26 persons died, Sub Judge Katra Manoj Parihar today convicted accused namely Kartar Nath son of Sh. Shiv Ram Resident of Mehari, Tehsil and District Reasi a Bus Driver for the offence under Sections 279/337/338/304-A RPC and 39/192 M.V. Act by imposing imprisonment of three years and fine of Rs. 2000/-. Brief facts of the case are that on 24.06.2009 at 06:55AM information was received through reliable sources that a Bus bearing registration no. JK02E/7525 being driven by its driver rashly and negligently manner from Katra to Udhampur when this bus reached near PCP Panthal the driver caused accident resulting to grievous injuries and because of serious injuries some passengers succumbed and died on spot and FIR No.79/2009 U/S 279/337//338/304-A RPC was registered in P/S Katra. After completion of investigation charge sheet was presented in the Court of Sub Judge Katra. Sub Judge Katra Manoj Parihar after hearing the counsel for accused and Prosecuting officer Kishore Kumar observed that prosecution have proved the case beyond reasonable doubt as the accused failed to observe the due care and attention and drove bus rashly and negligently on 24.06.2009 resulting in death of 26 persons and injuries to many others as such accused is found guilty U/S 279/337/338/304-A RPC and accused is convicted according and sentenced to undergo simple imprisonment of three years under section 279/337/338/304-A RPC, and 39/192 M.V Act by imposing fine of Rs. 2000/-.(JNF) |
