Bakra murder case: Court directs police to interrogate accused during 'judicial' custody | | | Early Times Report
Jammu, Dec 26: In a much publicized murder case of Sanjay Kumar alias Bakra, in a latest development when police filed an application seeking custody of one Deepak Kumar alias Deepu for further interrogation and for filling supplementary challan, a local court observed as the accused is only to be interrogated and the same can be done while he is in judicial custody. Principal Sessions Judge Jammu R S Jain after hearing Special Public Prosecutor Adv RS Kotwal appearing for the State observed that after perusal of challan shows that the accused Deepak Kumar was arrested during the trial of the case and he has been charge-sheeted for offence u/s 302 RPC. "During the trial, numbers of witnesses have been examined by the prosecution and it is pertinent to note that the accused was arrested on February 19, 2011 and since then prosecution sidelined te issue and now police is seeking custody of the accused Deepak Kumar on the ground that as per the investigation in the case, he is alleged to have converted the weapon of offence- a double barrel gun into short gun which was recovered from the place of occurrence, court said and also added an option was therefore left open that as and when the said Deepak Kumar is arrested in the case he would be interrogated to the effect as per law. Court further observed that looking he facts and the circumstances of the case and the fact that the accused is only to be interrogated and the same can be done while he is in judicial custody and directed that SHO/IO of P/S Bahu Fort will go to the Central Jail Kot-Bhalwal Jammu and conduct the interrogation of the accused Deepak Kumar in jail itself. |
