For 20 yrs, Jammu family struggles for piece of land, courtesy Housing Corp

JAMMU, May 19: Nullifying the motto of providing cheaper and suitable land to the houseless people in urban areas of the state, the J&K Cooperative Housing Corporation Ltd has failed to give a plot of land to one of the legitimate allottees in posh Tawi Vihar Colony at Sidhra for the last 20 years.
Naarating his tale of woes, Kapil Khajuria of City Chowk, Jammu told Early Times that despite approaching the J&K Cooperative Housing Corporation Ltd after regular intervals, the possession of plot at Tawi Vihar, Sidhra in his favour is still being denied on one pretext or the other.
"Our troubles started from the day we deposited advance amount of Rs 20,000 on 20-09-1995, receipt No. 2514, against the cost of a 12 marlas (40'x 80') plot at Tawi Vihar, Sidhra in the name of my mother Smt. Darshana Khajuria, one of the beneficiaries at Serial No. 66, who have deposited on account payment of plot at Tawi Vihar Sidhra," Kapil said.
"The booking cost was made under the rule of Corporation wherein one has to deposit at least 20 percent of the total price of a plot at the then prevailing rate of Rs 30 per square feet fixed by the Coprporation," he said.
Kapil said that even after paying the initial amount as
booking of the plot way back in 1995, his mother was never intimated regarding allocation of the plot till 2001.
"A letter vide No. JKCHC/3/TVS/4567, dated: 25-5-2001 was received from the Corporation mentioning allotment of plot in favour of my mother with a reduced size of measuring 30'x60' and that too with an escalated price of Rs 100 per square feet which means the said plot's rate was fixed on the then existing rate of Rs 1,80000 and we had to pay Rs 1,60000 as balance cost of the plot," Kapil said.
"The Corporation letter not only offered a reduced size price but it also raised the price at exorbitant rate of Rs 100 per square feet instead of agreed rate of Rs 30 per square feet at the time of booking the plot," he added.
After receiving the Corporation's faulty allotment letter, the mother of Kapil made a representation before the Assistant General Manager (Project), J&K Cooperative Housing Corporation Ltd to wherein she pleaded to stand by the assurance of providing the piece of land at the rate of Rs 30 per square feet but no attention was paid to her request.
In the meantime, health condition of Darshana Khajuria started deteriorating as she is a diabetic patient and therefore she wrote to Managing Director of the Corporation on May 16, 2005 that she had not yet taken over the possession of the plot allotted to her and due to her old age she is not able to follow the case.
In her letter, she requested the Managing Director to consider her son Kapil as her authorized nominee to take over possession of the plot on her behalf.
After getting the authorization from his mother, Kapil vigorously pursued the case and once again an allotment letter vide No. JKCHC/3/TVS/583, dated 26-5-2006 addressed to Kapil was received from the Corporation wherein it was mentioned, "In consideration of you having paid the premium, a Plot No 6, Phase XIII measuring as per site situated in Tawi Vihar Colony under category MIG is allotted to you."
However, a bigger disappointment was awaiting Kapil and his family as on physical verification of the site there was neither Phase XIII nor Plot No 6.
"To my utter disappointment, on ground there exists no Plot No 6 or Phase XIII in Tawi Vihar, Sidhra..... One of the senior engineers of the Corporation told me that at present there is no such phase, it would be developed in the future only," Kapil said.
"After that episode, I literally begged before the Corporation authorities to allot me a suitable plot somewhere in Tawi Vihar, Sidhra but they plainly say that all the plots have been distributed there and offered me to take possession of a plot in an alternative site of the Corporation which I refused hands down," said Kapil.
In between, Kapil made representations before Chairman, J&K Cooperative Housing Corporation Ltd in 2008, the Managing Director of the Corporation on May 7, 2014 with a copy to Registrar Cooperative Societies, J&K, Srinagar.
In response to Khajuria's representation, Deputy Registrar (C) Cooperative Societies, J&K, Srinagar Vide his letter No
RCS/JKCHC/06/iii/338-39, dated: 16-06-2014 wherein he directed the Managing Director of the Corporation to redress the grievances of the applicant under rules and furnish report to this office within 15 days but once again no action was taken to settle the case of Kapil.
