Promote Assistant Superintendent Kupwara Jail
Police Department ignore SHRC directions

BARAMULLA, Apr 9: Keeping the directions of State Human Rights Commission in abeyance the State Government has promoted the Assistant Superintendent, District Jail Kupwara, Ghulam Nabi Bhat to the position of Deputy Jail Superintendent.
State Human Rights Commission had asked the police higher ups not to promote any police officer without availing No Objection Certificate (NOC) from the commission. However paying no heed the department promoted Bhat to the position of Deputy Jail Superintendent, despite the fact he is accused in alleged custodial death of youth in Kupwara Jail lodged there under Public Safety Act.
Sajad Ahmad Dar was lodged in Kupwara jail from January 24, 2012 to March 22, 2012 under Public Safety Act vide FIR number 331/2011 under sections 420, 467 RPC and 10 ULA (P) Act at Police Station Sopore.
According to the family sources, 21 year old youth, Sajad son of Ghulam Nabi Dar of Sangrampora Sopore, was not provided timely treatment after he became ill to him during his detention in Kupwara Sub jail subsequently leading to his death.
Sajad's father, Ghulam Nabi Dar told Early Times that the family came to know on second death anniversary of their son that Government has promoted Bhat, then Assistant Jail Superintendent, to the rank of Deputy Jail Superintendent.
"Instead of initiating legal and disciplinary action against the accused officer, the authorities have promoted the accused. Despite indicted by magisterial inquiry for his negligence by failing to provide timely medicare besides shifting him to any super specialty hospital, the said officer has been rewarded with promotion," said Dar.
Sajad's mother Jana Begum said that on the intervening night of March 21 and 22 in 2012, Sajad got ill at Kupwara district jail but the jail authorities didn't pay any attention to his deteriorating health which grew worse by the morning. It was only after long delay he was shifted to SKIMS Soura, Srinagar where he breathed his last with the doctors termed the cause of death as cardiac arrest.
"The case was handed over to the High Court Srinagar, and we have a court hearing on April 11, 2014. Let us see what comes out there, but we are very sure that nothing is going to happen. Justice delayed means justice denied and same has happened with us," said Tariq Ahmad, brother of Sajad.
Following protests by people over the alleged custodial death of Sajad, Government had then ordered magisterial inquiry which was conducted by Additional District Magistrate, Kupwara who indicted the jail staff for negligence, leading to death of detainee.
"The deceased was physically fit having some acute problems and needs medical treatment, was not provided sufficient treatment which led to his death," the inquiry officer has concluded in his detailed summary of inquiry no: DMK/H/inq/2012 dated 02/ 04/2012.
