DB directs State to comply with directions
PIL regarding Security, Health, Construction of Chambers

Jammu, Apr 22 (JNF) : In a Public Interest Litigation filed Bar Association Jammu and Sumit Nayyar seeking various development around Court complex including parking, new road, health center and security of the Advocates, Judges and Litigants, Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar today took serious note for non-compliance of earlier Court order in which Division Bench directed Chief Secretary of J&K State to enforce the decisions taken by the committee under the supervision of the Registrar General of the High Court and in consultation with the President, Bar Association, Jammu. The decision with regard to hygiene and construction of toilets shall also be taken up. As per the suggestion made through the Registrar General World Sanitation Environment, a private organization like Sulabh has already been contacted by the Registrar General. The Chief Secretary may expedite the implementation of the decision by giving it priority, within a period of two weeks. A status report with regard to all other decisions be filed within six weeks. Today when the matter was taken-up, Division Bench observed that sanction has been accorded to release a sum of Rs.54.00 lakh in favour of Chief Engineer, PWD (R&B), Jammu for placing the same at disposal of the Managing Director, J&K PCC Limited for construction of Lawyers' Chambers. The aforesaid release order has been passed in pursuance of Government Order No.34-PD of 2014 dated 16.04.2014 stipulating that 25% of the current year's plan revenue component under State and District Sector as detailed in "Demand for Grants 2014-15" on the plan budget is to be released. Upon this Division Bench observed that "We fail to understand as to how the release of Rs.54.00 lakh would help in overcoming already created dues of J&KPCC which exceeds Rs.2.00 crores."
Division Bench further observed that On account of absence of counsel for the petitioner, we do not observe anything more than this at this stage and directed that matter be listed on June 12, 2014. Meanwhile order dated 06.03.2014 be complied with.
