Srinagar, Apr 22 : The Jammu and Kashmir High Court has dismissed four petitions filed by the state government and aggrieved candidates for review of the judgment of the division bench which had upheld a single bench decision. The single bench had quashed the selection list of teachers notified by Service Selection Board in 4 December 2012. "We do not see any error apparent on the face of the record in the judgment under review as would warrant its recall on review," a division bench of the court comprising Justice Hasnain Massodi and Justice Ali Mohammad Magrey said, dismissing all four review petitions. In the review petition, the government had stated that the division bench's view that HOD DIET is not head of the district has virtually set aside the Education ( Gazetted) Recruitment Rules of 1992. "The Principal DIET and Chief Education Officer are equivalent in grade and all the DIET principals are normally associated with the selection process of teachers in almost all the districts of Jammu and Kashmir," the review petition had stated. The review petition had also states that Neelam Gupta judgment has held that composition of selection committees is illegal but at the same time it has said the selected candidates should not be disturbed and the petitioners should also be considered for the selection. On December 4 2013, a single bench of Justice Mohammad Yaqoob Mir had quashed the provisional select list of 563 general line teachers in the frontier district. In 2012, the SSB had conducted interviews for the selection of the general category of teachers for district cadre Kupwara under various categories (322 in Open Merit, 46 in Social Caste, 56 in Scheduled Tribe, 112 in Resident of Backward Area, 17 Actual Line of Control, and 10 in Other Social Caste). |
