TS Wazir denied bail in Chopra Murder case
4/22/2014 11:26:05 PM
Jammu, Apr 22 (JNF) : Principal Sessions Judge Jammu Rakesh Sagar Jain today dismissed the bail application of Ex-MLC Trilochan Singh Wazir who is facing trial in Chopra Murder case.
Wazir had filed the application for bail for a limited period of three months to undergo medical treatment in a hospital outside the State since the required treatment is not available in the GMC hospital, Jammu.
It had been averred in the application that vide order dated 27.3.2014, this court while observing that the surgery required by the petitioner is not available in GMC hospital, Jammu issued the direction that Superintendent District Jail, Jammu is directed to get him medically examined in All India Institute of Medical Sciences, New Delhi under proper escort and follow the treatment advised by the doctors.
Principal Sessions Judge Jammu RS Jain after hearing Sr. Adv KS Johal with Advocate Rajesh Kumar for the accused person, observed that the allegations against the accused in the present case are that he entered into a criminal conspiracy with other accused and in pursuance of the criminal conspiracy committed murder of five persons. The allegations leveled against the accused are of very serious nature and against the society. Petitioner seeks bail for a limited period so, as to entitle him to get proper medical treatment under proper conditions.
However, looking to the allegations leveled against the accused and the larger interest of the State and the public as well as the settled law, Court is of the opinion that no good ground is made out for granting bail to the Trilochan Singh Wazir. Even, so, it may be noted that vide Order dated 27.3.2014, the Court had directed Superintendent, District Jail, Jammu to get the petitioner examined in AIIMS, New Delhi under proper escort and follow the treatment advised by the doctors and proceeded to dismiss the bail application. Since then, there has been no change in the circumstances to grant bail to the petitioner albeit for a short period also. With these observations Court dismissed the application of Trilochan Singh Wazir.
