Jammu, Nov 7: Principal Sessions Judge, Kathua, Vinod Chatterji Koul has acquitted Vijay Kumar and his mother Soma Devi who were facing trial in a dowry death case as prosecution failed. According to police case, on July 17, 2009, information was received telephonically from PCR Kathua that Sunita Kumari, wife of Vijay Kumar of Hiranagar, who had suffered burn injuries, had been admitted in GMCH, Jammu. During investigation, it was found that her death was due to burns. Proceedings under section 174 of CrPC were then initiated. During inquiry, SI Manwar Hussain inspected the spot of occurrence, conducted inquiry, recorded the statements of witnesses and also obtained the report of post-mortem. After conducting the inquiry, police found that the woman was beaten by her husband and mother-in-law on the ground that she had not given birth to a child and used to turn her out of the house. Because of the alleged behaviour of the accused, she was forced to commit suicide. After the completion of investigation, challan was presented in the court. After hearing the two sides, thye judge observed that the prosecution had failed to prove that the deceased committed suicide and commission of the suicide by the deceased was abetted by the accused and as such, charges framed against the accused are not to be proved beyond any doubt. Accordingly, the challan fails and the same is dismissed. The judge then ordered that the accused be acquitted of the charges. (JNF) |
