ROs reject PDP’s objections

Kishtwar, Nov 7:- Returning Officers for 51-Kishtwar and 52-Inderwal today turned down the objections raised by the Peoples Democratic Party (PDP) demanding rejection of nomination papers of Minister of State for Home and National Conference Candidate Sajjad Ahmed Kichloo, BJP candidate Sunil Sharma both contesting candidates from 51-Kishtwar Assembly Segment and Congress candidate Ghulam Mohammad Saroori from 52-Inderwal Assembly Segment on the ground that the trio concealed the information regarding registration of a FIR and criminal cases against them.
District coordinator PDP submitted the written objections in which it was stated that there was an FIR against Sajjad Ahmed Kichloo and Sunil Kumar Sharma. He added that both did not mention the same in their affidavits.
According Returning Officer 51-Kishtwar Mohammad Hanief Malik sought replies from the counsels of both Kichloo and Sharma with regard to the same.
Advocate Kuldeep Sharma and advocate Imtiyaz Ahmed Hamal counsels of Sajjad Ahmed Kichloo said that court had accepted the closure report of the FIR registered against him and accordingly dismissed the case as not admitted. They said that once the court accepted the closure report, it is not necessary to mention the details of the same. They also produced the court order regarding the said FIR registered by the police in much publicized slap gate case involving former CEO KDA Kishtwar.
While in case of the BJP candidate Sunil Sharma, his counsel advocate Vikas Sharma stated that it was not clear whether his client's name figured in FIR No. 131/2008 registered at police station Kishtwar in connection with August 12, 2008 Kishtwar communal riots. He said that there is mention of a name Sunil Kumar son of Des Raj of Kishtwar. He added that it is not clear that who is the accused in this FIR as his client has neither been summoned nor has received any warrant from the court. He said that the name mentioned in the FIR is not that of BJP candidate Sunil Kumar Sharma. He said on these grounds the objection raised by the PDP should be rejected. After hearing both the sides, RO 51-Kishtwar Mohammad Hanief Malik rejected the PDP objections and upheld the nomination papers of both BJP as well as NC candidate. He also rejected the nomination papers of PDP covering candidate Ishtaq Ahmed Waza. With this 10 candidates Nek Ram Manhas of Congress, Des Raj Baghat of BSP, Ajaiz Hussain Naik (NCP), Jaswant Singh (Independent), Gulzar Ahmed (Independent), Sunil Kumar Sharma (BJP), Firdous Ahmed Tak (PDP), Mohammad Amin Butt (JDS), Sajjad Ahmed Kichloo (NC) and Farooq Ahmed Ahanger (JK Peoples Party) remain in election fray from 51-Kishtwar Assembly. Meanwhile, RO 52-Inderwal Assembly Segment Sudarshan Kumar Salaria also rejected the PDP objections and upheld the nomination papers of Congress candidate Ghulam Mohammad Saroori. In his written objections, PDP stated that Saroori failed to mention the details of criminal proceedings U/S 500 Cr.PC (Defamation case) initiated against him by the court in relevant column, while it was mentioned in non relevant column. After hearing the arguments of both the sides, RO rejected the PDP objection with the plea that the candidate did not intend to conceal any information with regard to criminal proceedings while due to clerical error same was mentioned in another column and termed it non sufficient ground for rejection of the nomination papers. With this 13 candidates Ghulam Mohammad Saroori (Congress), Shanawaz Ahmed Ahanger (JKPP Independent), Jyoti Prakash of BSP, Farooq Ahmed Keen (Independent), Lakhmi Chand Sharma (Independent), Jabar Singh Parihar (Independent), Tanveer Hussain Babzada (RKSP), Imtiyaz Ahmed (JKNPP), Abdul Majid Ganie (Independent), Salam Din (NC), Ashiq Hussain (KDFIndependent), Abdul Majid Butt (PDP) and Tariq Hussain Keen (BJP) remain in election fray from 52-Inderwal. The last date of withdrawal of nomination papers is 10th of November 2014. During the course of the scrutiny, there were heated arguments between BJP candidate Sunil Sharma, PDP Candidate Firdous Ahmed Tak and Shabir Ahmed Kamal, Election agent of NC Candidate Sajjad Ahmed Kichloo over a certain derogatory remark made by the PDP candidate.
The BJP candidate and NC election agent objected to the remark of PDP candidate "Tumara Daman Daag Daar Hay Es Liyae Humne Objections Kiya, Mera Daman Saaf Hay Es Liyae Tum Kuch Nahi Kar Pa Rayae Ho (You are tainted and your clothes are full of muck, while I am with clean image, that is why you people have failed to level any allegation against me)" said Firdous Ahmed Tak. As soon as Tak made these comment, Sunil Sharma objected and advised him to maintain the decorum of ROs court. He advised him to fight elections on merit rather than indulging in such things. Later with intervention of RO and other committee members, the situation was brought under control. Meanwhile PDP has decided to move court against the decision of ROs for upholding the nomination papers of trio who according to PDP had concealed the information regarding criminal cases against them in their respective affidavits.
