Remove encroachments from 'khacharie land': HC

Srinagar, Nov 27 : A Division Bench of Jammu and Kashmir High Court has directed Divisional Commissioner Kashmir to ensure removal of encroachment from 'khacharie (grazing land). The division bench of Justice MuzaffarHussain Attar and Justice Ali Mohammad also directed all Deputy Commissioners in Jammu and Kashmir to follow statutory provisions and its directions banning conversion of agriculture land in the state faithfully. "Divisional Commissioner Kashmir is directed to ensure implementation of the statutory provisions regarding removal of encroachment from khacharie land and ensure that directions of the Supreme Court and this Court issued in various writ petitions are implemented," the division bench said
The officer shall be personally responsible to seek implementation of the provisions of the statute and court directions, the bench said ands asked him to file compliance report before the next date of hearing.
The directions followed submissions by advocate Jahangir IqbalGanie, the amicus curie in the case.
He said that the directions have been issued by High Court in various petitions requiring the concerned authorities to protect the land and remove, the encroachments from the khacharie land. He submitted that despite directions issued by the Supreme Court and the directions issued by High Court, no steps have been taken till date for actually removing the encroachments from the khacharie land. The court was hearing a Public Interest Litigation, seeking implementation of laws in their true spirit on conversion of agriculture land.
The court granted two weeks time to Secretary, Housing and Urban Development Department, to file an affidavit regarding court's observation that government shall explore the possibility by bringing out some plans in the adjoining area of the city of Srinagar to address the increasing demand for residential place.The division bench also directed Deputy Commissioner Budgam, and TehsildarKanipora to implement the provisions of J&K Brick Kilns Regulations Act, 2010 and J&K Brick Kilns Regulations, Rules, 2011.The court was hearing an application, seeking direction to the government to take immediate steps for stopping the establishment of brick kiln in agriculture and orchards of BrarigundChadoora in Budgam district.
