Governor Rule in J&K unconstitutional: Harsh

JAMMU, Jan 31: Describing the continuance of Governor Rule in J&K as unconstitutional, Harsh Dev Singh Chairman JKNPP and former Minister sought the dissolution of the suspended Assembly of the state and holding of fresh elections without further loss of time. In press statement he said that Sec 92 could not be used as a ploy by the central govt. to engage in proxy rule through the Governor especially in a situation when the formation of govt. appears to be a remote possibility.
He said that identical situation had occurred in Bihar in March-April 2005 when it was found by the Governor that no political Party or combination of Parties was capable of forming the govt. for lack of required majority. He said that apprehending allurements, bribes and unethical means, the then governor recommended dissolution to the President who as per the recommendation notified the dissolution of the said Assembly.
Describing the present political situation in the state as ripe for dissolution of Assembly, Harsh Dev Singh said that PDP having shown its reluctance to form the govt. with no response to the communiqués from Governor House and the NC and Congress already having conveyed their stand in media, it was only BJP which appeared to be interested in govt. formation.
He said that BJP having the support of only 28 MLAs was not in a position to form the govt. on its own despite its desperation. He said that with the stand of different political parties being evident, there seemed to be no possibility of govt. formation in the state. "There was no reason therefore to continue with the stalemate and called for a firm decision by the governor in conformity with the Parliamentary precedents and in accordance with mandate of constitution", he said, adding that governor's rule could not be continued only for the reason that the political parties were indecisive with regard to the formation of govt.
He said that if no plausible combination of political parties or alliance was coming forth to claim the formation of the govt., the only alternative left with the governor was to recommend the dissolution of the Assembly so as to pave way for fresh elections. Strongly flaying the BJP for its lust for power, Harsh Dev Singh said that the Saffron Party which was earlier opposing the candidature of Mahbooba Mufti for CM had now unilaterally announced the PDP president as their favorite choice for CM in the proposed govt. He said that it was utterly amusing to note the BJP leaders twisting and turning in their desperation to reach a political deal with PDP so that their ministerial berths remained secure.
