'Controversial' Javaid Rahi showered benefits, deserving forced to bite dust

SRINAGAR, Jan 31: Throwing all rules to wind Jammu & Kashmir Academy of Art, Culture and Languages (JKAACL) advertised a promotional post some 15 years back and the person appointed on the post has hogged headlines in the past and present since controversies have surrounded him.
In 2001, JKAACL advertised the promotional and non vacant post of Editor cum Cultural Officer, Gojri. At that time the post was held by Mohammad Mansha Khaki. Besides other candidates, the then Research Assistant, Gojri, Javaid Rahi also applied for this promotional, but non-vacant post.
Under Service Recruitment Rules of JKAACL notified vide Order No. 40 of 1996, dated 20.09.1996, the post of Editor cum Cultural Officer was a promotional post. The relevant rule reads as "i) Editor cum Cultural Officer (Gojri). Method of Recruitment: By promotion from Class IV, Cat. B (Gojri) with 7 years of service as such".
While advertising the post, the Academy did not seek the mandatory sanction of its Central Committee, which is the Executive Board of Academy vested with the power to lay down criteria and method for filling up of posts.
The Academy report too has highlighted this and several other major irregularities with respect to Rahi's appointment.
According to point 23 of report submitted by JKAACL to the Chief Minister's Secretariat and GAD in 2014 vide No. Adm/E/31/2013-14/7495, dated. 18.01.2014 interview and selection to the post to which Javaid Rahi was appointed was made despite court stay.
The memo of then Secretary JKAACL dated 25.10.2004 attests the fact that the court had restrained the Academy from proceeding ahead in the matter.
"However, the written judgment pronounced by the Court on 16.10.2004 has taken a different view. The Court has not ordered that: 'Considering the above facts and reasons the non applicant is temporarily restrained from filling up the post of Editor cum Cultural Officer, Gojri without advertising the post as mandated by law till disposal of suit," reads memo No. 969 of the then Secretary JKAACL.
On page 8 of the report dated 18 January 2014, JKAACL has stated that the dispatch register used for call letters was manipulated by pasting fresh paper on it. Communicating this fact to the Chief Minister’s office, the Academy report under point B appearing on page 8 states "The above dispatch number which stands already used had been manipulated by pasting fresh paper on the register…"
Under point 5 appearing on page 7 of the report, it has been admitted by Academy that when the State Vigilance Organization (SVO) sought the register in connection with a complaint, the dispatch register was shown as untraceable though it was very much available.
"In response to the complaint lodged against Javaid Rahi regarding minimizing the candidates in appearing the interview and informing the SVO that dispatch register is not traceable when the register is very much available," reads the report.
Incidentally, the VOK had received a complaint against Rahi's appointment and vide letter dated 25-02-2010 had sought documents which were not provided by JKAACL as Rahi used his posting at the Academy headquarter for denial of information on flimsy grounds vide letter of March 2010.
Pertinently the Academy report has admitted that "call letters bearing No. 1936-39, dated 19.08.2004 issued to members for conducting interview were addressed by Javaid Rahi, the then research assistant and a candidate for the post in his own handwriting".
Insiders privy to the selection process insist that the handwritten on letter dated 19.08.2004 addressed to members of selection committee is actually that of Javaid Rahi who was monitoring his own selection process.
There are several visible gaps pinpointed by JKAACL in its report of January, 2014 which highlight unprecedented forgery in the selection process relating to the appointment of Rahi to the promotional post of Editor cum Cultural Officer, Gojri.
Under point 10 of the report appearing on page 3, for instance, JKAACL authorities have stated that "the dispatch register shows only one entry against Ref. No. 1847-55, dated 12.01.2004, with initials reading as 'Javaid Rahi' which gives an impression that the call letters were either handed over to or received by Javaid Rahi"- a candidate for the post.
Similarly, under point 9 appearing on page 3 of the official report dated 18th January, 2014, JKAACL has admitted that "09 candidates had applied for the post to which Javaid Rahi was appointed - two of whom were candidates of the Academy."
Insiders, who were associated with the selection process, insist that blank envelopes were sent to eligible candidates most of whom were PhDs with a view to minimize the number of candidates for the post. Resultantly, not even a single PhD candidate turned up for the interview which was held in a secret manner without publicity of any kind.
Rahi's self monitoring of his own appointment is highlighted under point 12 of the January 2014 report appearing on page 3 wherein the Academy has admitted that no call letter was issued to the in-service candidate Javaid Rahi. This notwithstanding, he appeared in the interview and got selected.
