| Court acquits father, three sons in attempt to murder case | | | Early times report Jammu, Dec 13 (JNF): Principal Sessions Judge Kathua MK Hanjura has acquitted Nek Ram & his three sons namely Dev Raj, Kala Ram, Bachan Lal who were facing trial in attempt to murder case for the last more than 11 years as prosecution failed to prove its case. While acquitting the accused persons, the Principal Sessions Judge Kathua MK Hanjura after hearing Public Prosecutor Ravi Kumar Gupta for the state whereas Adv A Salathia appearing for the accused persons, took serious note of non-examination of investigating officer and observed that it is saddening to note that in this case also the investigationg officer has not been examined as a witness by the prosecution, though it has wended its tortuous course for a long time by now. It has taken almost none years to record the prosecution evidence only. During this period the investigating officer has not taken slightest trouble to enquire about its fate. Court took serious note and said that however, taking into consideration of the number of cases involving murders, rape etc where the IO do not appear as witnesses in the Court, monitoring appears to have taken a back seat now. If this situation persists criminals will rule the roots and it will be a sad day for all those who believe in the rule of law and acquitted the accused from the charges leveled against them. According to the prosecution case that on July 7, 2001, on a land dispute the accused party attacked on complainant party with the intention to kill them and police registered a case u/s 307/323/34 RPC and started investigation and after completion of the investigation challan was presented in the Court of law.
